DESIGNER OF SHINY TOYS Apple has won a preliminary injunction against the Samsung Galaxy Tab 10.1 that could ban sales of the "Ipad copy-cat" tablet in the US.
US District Court Judge Lucy Koh ruled in San Francisco on Tuesday that the injunction was justified by the similarity of the Android tablet's appearance to the Ipad, after Apple had claimed that Samsung "slavishly copied" its best-selling tablet.
"Although Samsung has a right to compete, it does not have a right to compete unfairly, by flooding the market with infringing products," Judge Koh said, adding that Apple must pay a £2.6m bond before the tablet is banned in case the injunction is later found unnecessary.
Unsurprisingly, Apple is pleased by the ruling. In a statement issued to The INQUIRER a spokesperson said, "It's no coincidence that Samsung's latest products look a lot like the Iphone and Ipad, from the shape of the hardware to the user interface and even the packaging.
"This kind of blatant copying is wrong and, as we've said many times before, we need to protect Apple's intellectual property when companies steal our ideas."
Samsung is likely to seek an appeal against Judge Koh's ruling, saying it will take necessary legal steps. It also said that the ruling is unlikely to have much impact on its business, as the ban doesn't affect the newly-released Galaxy Tab 10.1 2.
"Samsung is disappointed with the U.S. District Court for the Northern District of California's decision," the company said in a statement.
"We believe today's ruling will ultimately reduce the availability of superior technological features to consumers in the United States."
"Apple sought a preliminary injunction of Samsung's Galaxy Tab 10.1, based on a single design patent that addressed just one aspect of the product's overall design. Should Apple continue to make legal claims based on such a generic design patent, design innovation and progress in the industry could be restricted."
"We will take necessary legal steps and do not expect the ruling to have a significant impact on our business operations, as we possess a diverse range of Galaxy Tab products." µ
