FRUIT THEMED FIRM Apple's Iphone and Ipad could be banned in Germany after Motorola won a temporary injunction in the Mannheim Regional Court.
The case, which relates to Motorola's wireless technology patents, represents a huge loss for Apple in its tit for tat patent battles taking place around the world.
However, in typical fashion, Apple immediately said it would appeal the ruling. It said, "We're going to appeal the court's ruling right away. Holiday shoppers in Germany should have no problem finding the iPad or iPhone they want."
According to patent gadfly Florian Mueller, the ruling includes an injunction that is preliminarily enforceable against Ireland-based Apple Sales International in exchange for a €100mn (£85.4mn or $134m) bond unless Apple wins a stay.
He said on his blog, "Apple is certainly going to appeal this ruling to the Karlsruhe Higher Regional Court and to request a stay for the duration of the appellate proceedings. Such a suspension may or may not be granted."

Is it too early to take this as a sign that Apples fashionista fascism will finally be brought to an end?
If they truly were as superb as they want us to believe, I take it they wouldn't have to resort to this sort of annoying, damaging and utterly bad style legal bullying.
apple has to create everything for it's OS by itself.
Android is able to leverage all the work that is done for Linux.
In addition, much of the development work done by one manufacturer (drivers for example) end up being useful to many other manufacturers, so they are sharing that burden as well.
Apple is able to try radical new things faster than an android manufacturer can, but they are spending significantly more effort to do so.
but when apple starts defining it's 'innovation' as being a rectangular device with rounded corners and as small a border around the screen as they can manage, I have to wonder how much real innovation they are still doing.
at least this patent was a real hardware patent, not a software or 'design' patent
I`m scratching my head ... Apple have the software and hardware in one place to inovate together at whatever pace either of them want...the competition on the other hand get told by Google for Android this is what you got deal with it..
So why now when the mainstream is getting used to smartphones apple seems to be struggling even swamped to stay ahead in the mobile circus..
