FRUIT THEMED Apple is pushing for a ban on the redesigned Samsung Galaxy Tab tablet in Germany, having decided that it is not different enough from its Ipad design.
The arguments between the two companies are long and well documented. Apple says that Samsung has blatantly copied its designs, both in smartphones and tablets, and has repeatedly tried to stop it from selling its Galaxy Tab tablets.
According to the Dow Jones news service, Apple's legal people in Germany have appealed to have the new model Galaxy Tab tablet banned, despite it apparently being different enough not to confuse any potential buyers. We have asked Apple to confirm this but have not had a response.
A hearing is scheduled for 22 December in a Düsseldorf court, according to reports. The new filing comes just as Apple has lost an attempt to stop Samsung from selling its Galaxy Tab 10.1in tablet in Australia, an event that elicited the following response from Apple.
"It's no coincidence that Samsung's latest products look a lot like the iPhone and iPad, from the shape of the hardware to the user interface and even the packaging," said a spokesperson.
"This kind of blatant copying is wrong, and we need to protect Apple's intellectual property when companies steal our ideas." µ

Fuji brought out a tablet, rectangular with rounded corners in 1992. It had more buttons, but was a similar shape. Star-trek fans will remember that computer pads have been used on the show for years. How on earth did Apple get a design registered in such a way, when it is blatantly prior art ? If their products are as good as they say they are, they should allow the markets to decide who sells most product, based on their own merits. Me thinks an anti-trust style investigation by the EU is required to slap some sense into them !

Design is not IP. Besides, anybody with clear vision can see a difference between the two products. Apple has been trying to do this since they were using "brushed chrome" on their interfaces. As a designer myself, I know design follows trends. Just because Apple tends to create trends does not give them license to sue via thin.
Grrrrr Moment.
When will Apple ever learn there is more than one designer of Tablet PC's, Laptops, MP3 players who want to give people a choice.
I will never understand how a single company is so paranoid about others variation on a theme.

"This kind of blatant copying is wrong, and we need to protect Apple's intellectual property when companies steal our ideas, but we're allowed to steal ideas from anyone else."
Maybe Nokia & Sony Ericsson should raise claims against Apple:
They produced mobile phones for YEARS, then Apple copied their ideas and made a PHONE!
Thier phones had cameras for YEARS, then Apple put a camera on their phone!
Apple ripped off the idea to put video recording on their phone! (although it did take longer)
Their phones were able to be charged YEARS before Apple decided to copy it and make it phone re-chargable...
How about Diamond and Creative Labs raise some lawsuits about Apple copying their idea to release a MP3 player!
Apple are just scared of competition, and know that they're slowly losing users to Android, and with Samsung being the biggest phone maker in the world, they're trying as hard as they can to try to stop them... but it does make Apple look desperate and rather pathetic!
