BREIN scores a victory against a major Usenet provider

Bigger targets might be in its sights

MAFIAA BRUISER BREIN has won a battle against News Service, forcing Europe's largest Usenet provider to shut up shop.

News Service, which resells Usenet services to a number of other providers, had been mired in a two year legal battle against Dutch 'anti-piracy' outfit BREIN, which represents the movie and music industries. News Service requested a Dutch court to allow it to continue operations while it appealed a previous decision, however the request was denied, leaving the Usenet provider no choice but to shut down.

BREIN ordered News Service to remove all content that infringed copyright, however given the breadth of content available on Usenet, it was not surprising that News Service replied saying it couldn't comply.

News Service issued a statement saying, "Unfortunately, News-Service.com sees no way of complying with the Court's verdict. As a consequence, on 28 October, we started interlocutory proceedings and asked the summary Judge to order Brein to cease the execution of the verdict. We have learned today that the summary Judge has denied our claims. This means that we are forced to cease our operations with immediate effect."

While News Service is shutting down, the firm said it would continue to appeal the court's decision, though that action seems rather pointless now.

The MAFIAA has been going after Bittorrent tracker web sites for years, however this is the first win against a major Usenet provider and could spell the beginning of the end for Usenet as a content dissemination service. Usenet's binary newsgroups are well known for carrying the latest content even before it appears on popular Bittorrent trackers.

With News Service being forced to shut down, the MAFIAA's crosshairs might be placed on other major Usenet providers such as Astraweb and Giganews. µ

Never Going to Happen

Such a waste of time. There are countless other providers, and customers will just switch to someone else if a provider shuts. And if they manage to filter a USenet feed, people will just avoid it and use unfiltered feeds - in other jurisictions if necessary.

Let us remember that personal copying is a civil offense, is not a crime and is not theft:

You chop of one head, many more appear in it's place.

Let's face it, as long as we can take information off a disc and duplicate it, people will continue to nobble free stuff off the internet. Let's not dress it up in a 'legal technology and it's up to the user to use it' arument. Let's call it as wel see it: we all like free stuff and so does the bloke next door

Don't let the facts get in the way of the haters. They are very confused. They believe hating will make piracy legal, but not in this lifetime. They make prison cells for folks who can't live within the laws of society.

Naming

BREIN is not part of the US MPAA nor RIAA.
So the term MAFIAA just gained a new independence I guess, or you are giving BREIN way way too much credibility.

But if you use the term as a general term for a specific kind of fascist corrupt rat it works

What arrogance

There seem to be some morally illiterate people who believe it's acceptable to destroy a useful, used system because they disagree with one use of it.

Being arrogant and money grubbing is going to result in their end. Attacking copyright holders is a duty.

What ignorance

There seems to be some technically illiterate people who believe it's acceptable to illegally use or distribute copyright protected works. They are wrong as the judicial system confirms everyday.

Being ignorant or in denial does not change reality as the criminals learn daily. Attacking copyright holders for enforcing their copyrights is futile.
