Samsung demands Iphone 4S source code

Latest twist in patent spat with Apple

KOREAN ELECTRONICS GIANT Samsung is demanding the source code for the Iphone 4S firmware in its latest spat with Apple over patents.

Samsung's legal counsel, Cynthia Cochrane told the Australian federal court that Samsung needs access to the source code in order to assert that Apple is infringing three of its patents relating to wireless 3G, according to Smart Office.

Samsung also wants to see the agreements Apple made with mobile phone carriers Vodafone, Telstra and Optus, which it claims will also affect its case. It is not clear why it needs this information, but it might be attempting to make the point that Apple has made deals with these companies to give it an unfair advantage.

Apple denies it infringed the patents in question, claiming it is using them under the Fair, Reasonable, and Non-Discriminatory standard, but Samsung maintains that its international agreement with Apple does not extend to Australia and that Apple previously rejected an invitation to license the relevant patents.

Samsung wants sales of the Iphone 4S to be banned in Australia, a tit for tat move in response to the ban of the Galaxy Tab in Germany and an interim ban of the tablet in Australia.

The judge presiding over this case is Justice Annabel Bennett, who issued the interim injunction against the Galaxy Tab last month. It will be interesting to see if she will impose a ban on the Iphone 4S or again side in favour of Apple.

The case is expected to continue on 4 November, when the judge might decide if Samsung's demands are merited or not. µ

So the 4s was only called a 4s probably because it only had tech to match the samsung galaxy S II that came out months before plus Samsung has taken the top spot for mobile sales plus most apple products have samsung tech in them as they are samsungs biggest customer.(will they in future?)

Wouldn`t it make sense for both of them to come to a agreement to be a mobile powerhouse that would future proof them both being at the top as by the looks of things above samsung is slowly starting to control everything and someone else is just having a tantrum over it which wont solve anything.

If not Apple and Samsung are like AMD and Intel as in we need Samsung to stabilize the price.

Korea would boycott Australia ? Please start smoking dope to cure your paranoia.

Anyway, there is no way they should provide there source code and it's time that borderlines are met and enforced to protect OUR intellectual property that has been sabotaged by oriental countries.

Apple makes enough money and it's time these products are built in countries that meet our RIGHTS !

A global economy is a disintegration of our culture...wake up.

The judge in Australia was quite unfair and was clearly biased for Apple. She should be more careful this time round becoz the Koreans are quite capable of boycotting Australian agricultural goods which flood into the SKorean market(world's 13th biggest) at the moment, if they believe this will be another biased ruling by a Western court for a Western company..

Right. I'm sure Apple is going to let Samsung see the iPhone source code. I'd wager they would be willing to exit the Australian market before turning over the Holy Grail of code to a competitor.
