Oracle claims it has lost $1.16bn due to Android

Probably not as much as Nokia

SOFTWARE VENDOR Oracle now estimates it has lost $1.16bn from Google's alleged copyright and patent infringement by the Android operating system.

Last year Oracle sued Google claiming that its popular Android operating system infringed Java patents and copyrights. Since then the two sides have been trying to come to an agreement on any damages Google might have to pay.

Initially Oracle claimed $6.1bn from Google, but Judge William Alsup quickly told Oracle to come back with something more realistic. Oracle did just that yesterday with a figure $2.2bn, a figure that Google has urged the court to reject. Now Oracle claims it has lost $1.16bn due to Google's Android, though this figure is not related to the damages claim it made yesterday.

Google on the other hand has claimed that Oracle's expert witness Iain Cockburn, who calculated the damages, was a little too zealous in adding up his figures. Judge Alsup has already rebuked Google twice, once for trying to downplay the significance of Android and a second time for trying to use failed licensing talks with Sun to reduce any damage award.

Judge Alsup ordered Google CEO Larry Page and Oracle CEO Larry Ellison to sit down at a table and bash out a settlement before trial. However with the two firms seemingly offering completely different version of events it looks increasingly likely that both will turn up to court on 31 October. µ

Google, WTF?

So many good languages to choose, and Google had to pick the crappiest of them all.

And protected by patents!

Google, WTF?!?!???

How about this calculation?

Java is free to use on ever x86-based Windows PC and Mac on the planet. Ergo, Oracle has lost exactly zero dollars due to Android. If anything, Oracle's "Java" brand name has gotten a tiny bit more exposure, and up until Ellison's frothing, rabid money-grab lawsuit, had probably even garnered several million dollars in "goodwill" because of the use of Java in Android. Ellison, of course, has negated all that and pushed the balance the other way, but if there's any loss, it's due to Ellison, not to Google.

Are the calculations public record?

Now *that* would be worth an Inquirer story. And it'd be pretty funny too :-)

"They can easily spare $1B" :-)
"The more we ask for the more we'll get" :-)

Rubbish!!

They lost nothing as they didn't develop Java!! Exactly the reason why software patents should be non-transferable or cease to exist in total.
They hinder progress and are only abused by companies to grab money for doing nothing but suing others. Oracle should be accused abusing an open standard for profits while adding nothing.
When is this software-patent crap going to be banned???
