Twitter sues Twittad for ownership of ‘tweet’

MICRO-BLOGGING WEB SITE Twitter is suing advertising company Twittad over the term 'tweet', even though the latter actually coined the term.

According to our sister IT news web site V3.co.uk, Twitter is laying claim to the word under trademark. This is because the term 'tweet' is already owned by Twittad, which uses the annoying phrase "Let Your Ad Meet Tweets".

Therefore Twitter has filed a lawsuit for infringement of a trademark that it argues it should own, because it is the reason the term is popular, citing 'retweet' and 'tweetdeck' as evidence.

"This action arises from the registration of the mark 'Let Your Ad Meet Tweets' by Twittad in connection with online advertising services for use on Twitter," says the complaint.

"Defendant's registration unfairly exploits the widespread association by the consuming public of the mark 'tweet' with Twitter, and threatens to block Twitter from its registration and legitimate uses of its own mark." µ

This will not end well

This is not going to end well, at least for twitter. In fact given they really don't have any reasonably claim to the word since it doesn't directly relate to their original trademark nor did they originate the use of the word for that purpose I see this costing them a lot of money now that they've made a big deal out of it, possibly even the rights to tweetdeck that they paid 25 million pounds for earlier this year.
