Apple looks to ban all Samsung Galaxy devices in EU

MAKER OF SHINY TOYS Apple is demanding that Samsung's entire line of Galaxy branded devices be banned in Europe with a recall.

What was initially Apple's request for a ban on just the Samsung Galaxy Tab 10.1 is now a more broad appeal for any device under the Galaxy name, including the flagship Galaxy S II. Apple's reasoning is the same old complaint about patent infringement that we're getting so used to hearing.

The fruit themed company was granted a preliminary injunction against the Galaxy Tab 10.1 in all European countries apart from the Netherlands, stopping Samsung from selling the tablet. The ban has since been partially lifted for countries apart from Germany.

The ban Apple is now requesting is quite extensive and covers manufacturing, stocking, importing, distributing, trading or selling by Samsung Korea and its Dutch subsidiaries, according to Computerworld.

Apple also wants Samsung to send a letter to all of its European resellers asking for the return of all infringing products within 14 days and an offer of compensation. It also wants the letter to state that failure to do so will amount to infringing its patents.

"If this injunction is granted it could have 'significant implications' for the European market for smartphones and tablets," said Alastair Edwards, principal analyst at Canalys, "This is a very big threat to Samsung, because basically their whole European supply chain will be broken."

The German court will rule on 15 September and at a hearing last week, Judge Edger Brinkman said that any injunctions granted will come to effect on 13 October at the earliest. µ

Apple really are sinking low, it's fair enough to have legal disputes but to demand Samsung gives refunds....shocking!
At least Samsung released a product that worked, Apple really should be sued properly for its shoddy reception issues on the iplop4; not getting away with it by giving away a free case!

I really hope it all unravels on Apple, they thrive on stagnating development and fighting its corner rather than winning any sort if race in the long term..... I'm sure under consumer rights they have no technical way of refunding any phone within a two year period.

Apple Becoming Desperate

If their claims against all these Samsung devices were valid, why didn’t they bring them up in the German case, why only the Galaxy Tab 10.1 there?

I think they’re just cranking up the bluster level to cover up their collapsing case.

Let the customers look at the devices in the shops, and decide for themselves which one is better. What has the genuinely superior product got to fear from competition?

Samsung will probably delay everything until Galaxy S III begin next year.
Some minor tweaks will make it OK.

No Proof, but..

Samsung are supposed to be making googles nexus prime.
IMO the panic is all about nfc payments. Apple is trying to stop or at least delay Google from establishing an alternative payments ecosytem. (Which is probably why Google+ insists on real names - it wants to interface with your bank)

Demise near

If it were any other company, the amount of anal hemorrhaging would be reduced by no less than 2/3. However, let's not forget about the first mobile phone with a capacitive touchscreen, LG Prada, which ideas and concept were blatantly stolen by Apple, and from there originated all the iPhonorrhea that we became accustomed to. Despite all the legal implications it might have generated, was Apple ever forbidden to market its products? No. That says a lot about a company's character.

Haha Steve T. you tried to invoke sympathy for apple by pulling in freaking sony, that's just hilarious.
I think some might not mind apple, but I think everybody despises sony universally, so it does work to bring up an entity that's liked less than apple, except you brought them up as the lovable ones, that's just surreal.

To buy or not to buy that is the question.

When apple screams like a pig, I agree with another commenter, its time to look at the other product. I especially despise a company that tries to shut down the competition. Can some one verify that apple fears that Galaxy can be upgradeable,software, whereby apple users have to sell then buy new to do a similar upgrade.Something has thrown the fear into apple. They were just unpacking the galaxy 10 and I couldn't stick around to see it in action. Anyone want to comment on the new Galaxy.

Reading comprehension has never been a strong point

for Inq journalists. This is more detail about the case in Holand that we already know about, not something new.

In response to the resident fandroids and Apple haters (1) Apple paid Xerox for the idea of the GUI (in the form of pre-IPO shares), and then turned it into something quite different from Xerox's prototype.

2) the quote about good artists borrowing, great artists stealing was actualy Jobs (mis)quoting someone else. There's some argument over the originator, but the important fact is that the quote goes on "the great artist welds his theft into a whole of feeling which is unique, utterly different from which it is torn". If Google and Android manufacturers could do this then Apple wouldn't have a case, as it is they're trying to get as close as they can to Apple's design.

3) "Apple can't compete" Why should they have to compete with their own ideas? If some Chinese knock-off producer were to make cheap copies of, say, Sony products then quite rightly they'd be angry and looking to sue somebody. Why should Apple be any different?
