KOREAN ELECTRONICS GIANT Samsung has been banned by a German court from distributing its Galaxy Tab 10.1 tablet in Europe.
Rival tablet maker Apple has been granted a preliminary injunction against Samsung's latest tablet, the Galaxy Tab 10.1 that runs Google's Android operating system. The ruling prohibits Samsung from distributing the tablet in Europe with the exception of the Netherlands.
It means the tablet will need to be removed from the shelves and Samsung will need to stop marketing it.
As usual, Apple is claiming that its adversary's tablet infringes patents relating to its Ipad 2.
The fruit themed firm has asked the Düsseldorf district court for an injunction which will mean a fine of $350,000 for each violation or even imprisonment of management according to the Telegraph.
Samsung can appeal the decision. We spoke with Samsung, but it declined to confirm the ruling or comment on the matter. µ

it's just silly, they can make different looking products in the TV market for example (I own sammy TV) so why can't they make something nice and sleek in this segment (phone and tablet).
I don't want to argue your findings, i've got both in front of me on the desk. Galaxy Tab 10.1 does look like an iPad.
look at HTC - that's good example. none of their products looks like an iPhone
is it really hard for Samsung to invest money and design something unique?
When you think about it, you as end user would benefit more from more unique design than from one and many copycats which (as it stands now) can't compete

the lack of your understanding of the problem here is staggering. first of all, this relates to EU. Holland has different law and there's different suit filed with Dutch courts (hearing is planned for today).
second: this is 'look and feel' patent and if you are not completely blind you would agree that galaxy line of samsung products (including packaging) copies apple's design - quite 'slavishly'

Well, that does it for me. I will not ever be buying any Apple products again. Since they can't compete on the strength of their products alone, they resort to this nonsense? And yes, did Germany take control of all of Europe (accept the Netherlands)??
Funny that apple claims Samsung ripped them off, seeing as Apple ripped off Xerox when they created their first GUI after Jobs and Wozniak visited PARC in the '70s. So nearly everything Apple has "created" from the Mac to the iPad has elements that were effectively lifted from others ...bloody hypocrites!
Did Hitler win anyway? I know that sounds bad, but since when does a court ruling in Germany dictate policy for all of Europe? Were they granted some sort of special power?
And it's a temporary injunction. Meaning it won't last long. And, I suspect it's pretty easy to get those to start. And I also suspect there are no sanctions against a company such as Apple when the ruling is overturned.
And, what happens when Apple's products are banned from Europe for similar causes by a German court?
