SOMETIME GAMING HOUSE Sony has seen one of its insurers take it to court to avoid shelling out for network intrusions and data breaches that took place earlier this year.
Reuters reports that Zurich American Insurance is asking the courts to protect it against having to pay for the privilege of defending the firm, which we are led to believe did not do a very good job of protecting itself in the first place.
The insurers have requested relief from indemnifying Sony against claims "asserted in the class-action lawsuits, miscellaneous claims, or potential future actions instituted by any state attorney general," adds the report.
Sony has offered an indemnification package to its users after it watched as data belonging to about 100 million of them was stolen, and it is not unlikely that it will have to pay some sort of compensation somewhere.
Reuters added that the insurance firm asserts that it only covered Sony and its users against "bodily injury, property damage or personal and advertising injury", and explained that court documents suggest that the firm has been involved in 55 class-action complaints so far. µ
Maybe it depends on in what region you are? And maybe in some parts of the world they feel it's alright to try to screw the little guy specifically.
But I recall incidents where I thought an insurance company would try to weasel out and they did not, against my expectations, but at the same time I believe your story to be true too.
Anyway; Stay strong, and good for you that you persisted and had the strength to not give up.
I whole-heartedly agree with the sentiments expressed about insurers being money grabbing scum bags.
The amount of 'get-out' clauses is in their terms and conditions is ridiculous. It's only when you come to claim that you find out you have been sold a very expensive piece of paper.
Stop hiding behind bullshit terms and conditions and actually provide a worthwhile service. A clear case of the 'big man' squeezing a few extra pennies (probably to buy another super-car) whilst people go starving in famine ridden somalia - do they have no scruples?
Surely I can't be the only one to think that these scumbags are as bad those money grabbing "no win, no fee" lawyers?
The world would be a better place with out them.
in eq2 at least, we all recieved 45days free gametime, equivilant to roughly 22$
soe attempting to do their part should recieve a similar compensation from their insurer, after all - thats what they are there for
In one instance I was at work and was hit by a drunk driver that ran a red light. I was wearing my seatbelt but due to the angle of the hit my head went through the side window. The top neurologist in my area confirmed I had brain damage. Post Traumatic Syndrome. The insurance company tried everything to fight me. They sent me to their pet neurologist but he didn't want to argue with a top man in the field so he concurred with his diagnosis. Next they sent a PI to film me and question my neighbours. That attempt fell flat. They still dragged it out for 5 years before I got a settlement. I had to pay my lawyer nearly $20,000 and that came out of my settlement. I've seen the same thing happen to so many of my friends over the years. No offence but I just don't believe you. I suspect you're getting your information from insurance company commercials on television.
That's what my cynical mind always fears but in reality they almost never seem to mind to pay out really.
I guess their profits are so immense that it does not affect them?
And anyway if the claims about the sony contract are true then they are right.
Insurance companies love taking money from the public but when it comes time to meet their obligations and pay a claim they suddenly turn into adversaries and attack you as a thief and a degenerate liar. And since they throw so much money at politicians they are never held to account for these actions.
The problem with this is that sony are such assholes that their response will be doing something nasty to the public at large.
