THE PATENT BATTLE between HTC and Apple is going the latter's way after a judge made a preliminary ruling in its favour.
Apple won the preliminary ruling at the end of last week, giving it more confidence that it will prevail in its complaint that HTC is infringing two of its patents. HTC of course will continue to litigate the matter, because as we all know much of the business of the modern IT firm is to sit in court rooms and squabble over who did what to whom and when and how.
Although the judge has approved of two out of the dozen claims made by Apple, HTC was relatively relaxed about the decision. However this might have been because it had not had a proper chance to read about it before it felt compelled to comment.
"We are highly confident we have a strong case for the ITC appeals process and are fully prepared to defend ourselves using all means possible," said Grace Lei, general counsel of HTC in a statement.
"We strongly believe we have alternate solutions in place for the issues raised by Apple. We look forward to resolving this case, so we can continue creating the most innovative mobile experiences for consumers."
The devices in question are something of a mystery but it is more than likely that they are smartphones. Apple's ideal seems to be a total ban on imports of any infringing HTC products, and this is something that the International Trade Commission (ITC) can approve.
This preliminary ruling was made by an ITC judge, but the final decision will be laid down by the ITC in full. µ

Well lets see here, the US patent system is broken beyond repair, the only solution is to junk it and completely start over and then only issue patents for true innovation (not the M$ kind where I have a box that does "something"). And just because some retarded bureaucrat at the USPTO doesn't find something obvious, that doesn't mean it isn't.
The govt gets way too much $$$ from approving junk patents, so things will continue as status quo for the foreseeable future.
HTC and maybe all the android users are a sizable segment of the population.
They should raly against the US patent office for issuing patents that are vague and covers even prior art.
Its the US patent office that should be held under public scrutiny.
Apple cannot bear competition.
If Apple wins this case, technology advances will be curtailed everywhere and not just smartphones. There are
analogues in the computer wordl that the two patents can be applied to even if these processeses already existed well before the patent.

Patents are monopolies themselves - that's the first problem! No-one should be surprised that the consequence of granting people monopolies is anticompetitive behaviour, cartel formation (see the Nortel patent auction) and extortion ("it would be a shame if you couldn't sell your products any more"), and so on.
This is so stupid. Apple is abusing the powers given by having patents. I can't see how this is much different from issues regarding with monopoly.
I honestly don't think it'll turn out so ridiculous that multiple companies running Android will be impacted. It'll either be settled or something bad will happen to Apple.
