Apple accuses Samsung of harassment for wanting to see Iphone 5 and Ipad 3

Asks the court to deny Samsung's request

THE LITIGATION between Apple and Samsung is escalating, with Apple accusing Samsung of harassment in its request to see prototypes of the Iphone 5 and Ipad 3.

At the end of May Samsung filed a discovery request for Apple to hand over future products to it for inspection, in reciprocation for a court order it received to hand over its upcoming Galaxy smartphone and tablet models. It claimed that it was being put at a major disadvantage by having its future products exposed to a rival when those of that rival were not also shared.

Apple has responded to this request by calling Samsung's request "misconceived", "simplistic" and "unavailing". It said that its claim that Samsung infringed its patents relates to current products, not future products, and that seeing those future products could have no relevance to Samsung's defence.

Apple claims that the previous court order that Samsung must hand over its future products to Apple was made on the basis that images and samples were already released to the public and that they were seen by Apple to be infringing its current products.

It said that Samsung previously filed a response to Apple's request to see its upcoming models relating to various documents and surveys. Apple agreed to meet about this and provide the relevant material if deemed necessary, but it said that Samsung since withdrew that request and opted to file a new discovery request related to Apple's upcoming product range instead.

It said that its future products are extremely sensitive trade secrets and that Samsung offered nothing but "rank speculation" about them. It added that Samsung has not shown that future Apple products are directly relevant or central to the case, and therefore its motion should be denied.

In fact, it went even further and said that Samsung's filing was not made in good faith that it was rather a "transparent and improper attempt to harass Apple".

The dispute began in April when Apple accused Samsung of copying its designs, down to the packaging. Samsung countersued and it has been a tit for tat legal battle ever since, with both companies becoming more embittered in their responses. Suing for past products is one thing, but now that the future products of both companies are on the line neither party will give up easily. µ

So apple can see evereyone else's ideas but they can keep theirs to themselfs i dont think so apple we want to see every single idea you have and it has to get WORLD approval before you can even think of attempting to get a patent to use it

Are you two idiots or are you feigning ignorance, all the products apple asked to see have been "seen" already. Meaning we know they exist, as of right now do you even know the name of apples new iphone? no you don't apples point is they are mad at samsung for copying apples current product line.

I don't know what Apple expected. They make the claim that Samsung is infringing and didn't see this coming? As if Samsung is going to take it on Apple's "good faith." If someone claims I'm copying them, it's common-sense I'm going to want them to show ME how I'm doing so. The argument that Apple wasn't asking for anything that wasn't public already is bs. This article inaccurately describes the situation. Apple was asking for (and received) prototypes of two tablets and three phones. It was Apple that opened this can of worms which begs the question of why certain people are feigning surprise or being obtuse on the matter.

This makes perfect sense. Apple sues Samsung because they say their products resemble their own.

Apple forces Samsung to reveal their future products (which have not been released yet).

Samsung asks to see Apple's products, just to make sure they are charting a course away from Apple's "sensitive, artistic designs".

Apple, of course, does not think that this is fair. They want to continue to sue whoever, whenever they want, for any reason. Perhaps think about this before you consider buying any Apple products, using Itunes, the "I-cloud", or any other Apple services. If you want to support a corporate bully which stifles competition via lawsuits, Apple is the product for you (Microsoft being a close second).

Oh well, Apple lost perhaps the top provider of components for their I-gadgets over this "artistic legal squabble". Serves them right, IMHO.
