TABLET AND SMARTPHONE MAKER Samsung has escalated its patent dispute with Apple by asking a court to force Apple to hand over the Ipad 3 and Iphone 5.
The request follows a previous court order by US District Court Judge Lucy Koh in early May that required Samsung to give Apple a number of its upcoming Galaxy smartphone and tablet models, in addition to other potentially infringing products.
Samsung argues that this puts the company at a "significant disadvantage" by allowing Apple access to its new products without returning the favour. Samsung claims that it should have the next-generation Iphone and Ipad so that it can "prepare its defence", according to Reuters.
The dispute began when Apple sued Samsung in mid-April, claiming it "slavishly" copied its design and packaging. A week later Samsung countersued, claiming that Apple's products infringe its patents. This latest move is another tit-for-tat action in the heated litigation.
Samsung used to be one of Apple's allies, supplying it with £3.7 billion worth of chips and parts in 2010. However, tensions grew between the companies as Samsung's products, which run Google's Android operating system, became the primary competition to Apple.
The Galaxy Tab is the biggest threat to the Ipad, while the Samsung Galaxy S handset was used as the base for the Nexus S, Google's second own-branded Android smartphone. This strong relationship with Google is likely a factor in Samsung's souring relationship with Apple, particularly given the remarkable growth of Android devices over the past year and the impact that has had on Apple's sales.
Apple is typically tight-lipped about its upcoming products, so much so that it has a history of going after people who leaked its designs. Foxconn, which assembles Apple products, interrogated people over the leak of an Iphone, while a Gizmodo editor's house was raided after he published information about an Iphone 4 prototype.
This secrecy might help Apple keep an advantage in the market that Samsung can use as a defence against Apple's claims, but the same argument could apply to Samsung's products and is unlikely to wash with the court. µ

I suspect that if that were true it would be a simple open and shut case and there wouldnt be lawsuits spanning several different countries. Non the less the proof is in the pudding, but I dont see any pudding here.
Occum's Razor...if Apple HAD proof they wouldnt waste millions on lawsuits that arent needed and just cost money.

I suspect the issue is not that Samsung's market share is eroding Apple's, it's that Samsung blatantly copied the iPhone both physically and user interface wise. Before the iPhone, smart phone interfaces and physical shapes were different. The iPhone was innovative and is now iconic - like it or not.

Todays newspaper here in DK had a 2 page spread about product copying, China being the main culprit, where they steal everything with no compunction or moral qualms. China is just the worst of the bunch.
It seems that ASUS UX21 has copied directly from the MacAir as well - righyt dfown to the positioning of the ports.

Ok, not many here are Apple iDiots, including, definitely or hopefully myself. In fact, i even own Samsung GalaxyS Vibrant which all people insult me being confused with iPhone3s. LOL But i can not stand blatant shameless robbery of Apple by Asian copycats. This is literally staggering. Have anyone here invented something in science, technology or even the style or look that was just taken for nothing?? Do you know how hard to make something new and how easy to copy or steal it? It takes the whole life to make a 1-2 breakthroughs and just a glance to steal it.
Any more doubts of shear computer industry mass copying of the style and features after tablet movement Apple started? Remember everyone here predicted Apple tablet failure initially? iPhone iPad iPod -- fre#%ing everyone bites now a piece of forbidden apple. Without Apple we would still hide from everyone eyes those gray dumb bricks of Nokia and HTC. Forgot those?
And amazing that insulted by too high by their taste prices Amercans here do not protect its intellectual achievements. Everyone just hates Apple. Let them sell its iWare to their iDiots, and be happy.
That's by the way almost the only what America sells as kind of fashionable. Lose 3-4 of such last hi-tech things and also falling dollar and America will turn into the third world sewer with unsustainable debt burden literally overnight.

I think consumers are starting to grasp that Apple = Todays AOL. A company that believes they know whats best for you.
