ONLINE BOOKSELLER Amazon is fighting back against Apple for its right to use the name "App Store", which Apple has claimed is one of its trademarks.
Apple sued Amazon over the term last month, after having issued cease and desist requests that Amazon had ignored. Now Amazon has responded to Apple's lawsuit with a strong line of defence.
According to V3.co.uk, Amazon is asserting that that the phrase is too generic to be a trademark, and to support its claim it is quoting several instances where Apple has used the phrase in a generic manner, such as when Apple's CEO, Steve Jobs said that the Itunes App Store is "the easiest to use, largest app store in the world".
Because Apple itself has used the term generically, Amazon might get the case dismissed. It will be difficult for Apple to claim that its store is "the App Store" when it has referred to it as the best among a selection of many others.
Microsoft has also voiced concerns about Apple's attempts to appropriate the phrase. It too emphasised that the term is generic and asked the US Patent and Trademark Office to re-examine the trademark. µ

When I grew up an App Store was a synonym for an Appliance Store since most could not afford that much neon lighting so Apple should not profess to inventing the term "App Store" no more than they should "Store", but they would.

The term 'app', short for APPlication, has been around the computer industry for decades.
What's next. Illegal use of the word 'The' because it is Pooh Bears middle name!

I think it means, instead, a software product for a computer system whereby the computer system's competitors are surpassed. Example: Angry Birds is the killer app for smartphone game playing, therefore you must choose a phone that can run Angry Birds. First you choose the software that you want to run, then you pick a computer device that can run that software.
Does Windows Phone 7 have a killer app? If it doesn't, then it had better go get one.
Going by Apple's adverts, the iPhone killer app is the ease with which it provides services that extract money from you -
iTunes, the Book-that's-more-expensive-than-a-hardcover Club, and so on. iTunes actively encourages you to spend money on more music that sounds quite like the music you already (don't) own, and apparently that's a selling point for the device itself. (And for iPads, I assume. "If you don't have an iPhone", you might have an iPad.)
