Playstation hacker gets restrained by Sony
JAPANESE CONSOLE VENDOR Sony has had a temporary restraining order granted against a Playstation hacker.
Sony filed a lawsuit against hacker Geohot, real name George Hotz, for jailbreaking the 3.55 firmware on his Playstation. US Judge Susan Illston granted the order, saying that Hotz apparently violated the Digital Millennium Copyright Act and the Computer Fraud and Abuse Act as well as local Californian laws.
The court order was posted over at the Playstation modding community PSX Scene, accompanied by a picture of Hotz with his lips sealed by tape.
Hotz jailbroke his Playstation but Sony didn't want to rest its complaint on only one charge so it issued an barrage of charges against the modder to make sure at least one would stick. According to the court order, Hotz, "circumvented effective technological protection measures", "trafficked in circumvention" and used "encryption and/or decryption keys".
The temporary restraining order isn't the final word on the matter. Judge Illston said it is "in effect until the date for the hearing on the Order to Show Cause".
That leaves Hotz's defence team until February 1 to persuade Judge Illston to dismiss the motion due to lack of personal jurisdiction, where it argues that the court doesn't have the power to issue the order.
Unfortunately for Hotz, Judge Illston has already decided her court has personal jurisdiction because he was putting his modded work online.
"The court may exercise specific jurisdiction over Hotz because he purposefully directed his activities at the forum state," she wrote.
Sony has already released a security firmware 3.56 update that does little more than circumvent the jailbreak Hotz developed. Given the persistent nature of modders, we don't expect that to last long. µ

Hackers are pleased with running whatever software they like. Hence, no hacking attempts.
Sony says allowing 3rd-party software is a threat to their copy-protection scheme. 3rd-party support is removed.
Hackers are furious and start hacking away. Master key is found, hackers jailbreak their consoles. Enter crackers and cheaters.
Sony spins media, says jailbreak is for pirated games and cheating. Since the protection relies on a master key that they can't change, new firmwares are easily hacked.
We can conclude that, by removing 3rd-party support, Sony effectively hacked their console themselves.
Hackers don't break protection schemes to run their pirated games or to cheat. They do it for the freedom to do whatever they want or simply the challenge. As long as Sony allowed them access to 3rd-party software, the PS3 was simply not of interest for them.
Some people have confused jailbreaking with cheating. Also what some of you have failed to see is that according to the library of congress, this is perfectly legal. The only reason for the jailbreak was to allow modders to install an alternate operating system (aka Linux). Why would people need to do this you ask? Well, if you knew anything about the PlayStation 3, this was something that Sony already had built into the system since the PlayStation 3 was released. Unfortunately due to some poor decision making by people running the show at Sony, this option was removed a few months ago. This is the only reason people are just now trying to jailbreak the PlayStation, it was completely unnecessary a few months ago. Good work Sony, you made yourself a bigger problem that will only continue to get bigger if you decide to keep going down this path.

I've hated sony for years and I hope the choke to death on their own stupidity.
