ONETIME SMARTPHONE SELLER Google has been slapped with a class action lawsuit claiming that its Nexus One smartphone cannot maintain a 3G data connection.
The lawsuit was brought by Nathan Nabors who is seeking damages on behalf of the residents of California and Florida, alleging that Google did not warn users that even in areas where T-Mobile had 3G capabilities, users might not receive 3G connectivity. When it launched the Nexus One, Google partnered with the US mobile operator T-Mobile and it didn't take long for complaints to pile up.
Google was faced with connectivity complaints after the launch, though things did calm down and focus shifted to disappointing sales figures. The firm finally pulled the plug on its direct sales experiment in July, although devices that were set aside for developers quickly sold out. It seems that the direct sales model that served Google so badly is also the reason why Nexus One manufacturer HTC and T-Mobile itself have not been named in the lawsuit.
Nabors alleges that Google made misleading claims about the Nexus One and that its customer service wasn't up to scratch either.
It'll be interesting to see how Nabors does with his lawsuit as there is another handset that has widely reported connectivity issues, with the manufacturer unwilling to admit that it's at fault. As for Nabor's chances of success in court, we wish him luck because we suspect he'll need it. µ

I have an AT&T version of the Nexus One and it maintains a very good connection with 3G. I guess the person who started this suit has nothing better to do with their time than make frivolous complaints.
