THE SELLER OF SHINY TOYS that it apparently rushes to market without testing them too much, Apple is being sued by a couple of people who aren't happy about the Iphone 4 antenna problem.
Already part of Apple infamy, the Iphone 4 has an antenna that can be blocked should the user decide to hold the thing to make a call, especially with their left hand.
Although Steve jobs thinks the problem can be solved by holding the Iphone another way, perhaps with two fingers, this is not really good enough.
Reacting to this, two disgruntled US Iphone 4 customers are suing Apple.
Gizomodo has the court dockets and a glance at them tells us that Kevin McCaffrey and Linda Wrinn will argue that the devices are defective and drop calls when "held in a manner consistent with normal wireless phone use."
The pair of them can't have been shy of offers from lawyers keen to flex their muscles, get in the papers, and buy a holiday home, and in this instance, the attorneys have decided to throw everything at Apple.
So, Apple is being sued for being negligent, colluding with AT&T to mislead people, fraud by concealment, design defects and failing to honour its warranty.
There is plenty of information for the courts to go on and the papers include all the juicy information that's been filling blogs for days. Kicking off with Jobs' advice on how to use your hands, it also includes evidence of similar tips given out by Apple helpdesk staffers and Apple's decision not to fix the problem under warranty.
Apple sold 1.7 million Iphone 4s in just three days, but it has not released any information on how many people have tried to return them. µ
The only lawsuits I support are individual ones or government ones. These lawyers ganging just to get rich show no other motive than to get themselves rich. They will make millions and a few hundred people will get some coupons for $10. It's very sad and very predictable. I would have no problem with companies paying hefty fines for false advertising, but these lawyers who pull this sort of thing are nothing more than parasites living off the free market.
Have no fear, then. This is the Internet. Overhyping is the only thing it knows.
There are a lot of frivolous lawsuits these days, but some are legitimate and that's way they are made. If a company puts out defective products and does nothing about it they should be sued. When profit is the only motive, there is no other choice. And Apple won't care if they lose, they just take a big loss and the stockholders pay. Thats why I don't like the stock market anymore.
Just recall them and sell them as the new iPods.
The Nexus 1 forums also have threads about exactly the same issue - dropping bars when held in a certain way. So it isn't just the iPhone 4. And since the reception on the iPhone 4 is demonstrably better than the 3GS - even when handheld cupped - this is not likely to upset Apple's coffers.

Just don't buy apple and they will have to change, I know its hard to take this in if you are an apple lover, but really its for the best.
Every other cell phone manufacturer will win from this. Already Nokia and Motorola are taking jabs at this, and rightly so. This needs to get overhyped (as Apple overhypes it's products) until Apple stock starts to sink and stink.
What a wonderful opportunity to kick Jobs in the nuts as he so deserves. Kick hard!

Best case for the plaintiffs is they'll get some token like a voucher for a bumper. This will be some months if not years in the future (the iPhone 5 or 6 may be out by then).
Meanwhile the vast majority of users will either have no problems or use one of many simple workarounds (including using a piece of Scotch tape, can't get much cheaper than that).
A new app on Apple's app-store:
- Generates animated wallpaper for the Iphone4 of Steve Jobs' face.
- "Steve" shakes his head disapprovingly if you hold "his" Iphone "wrong".
- "Steve nods his head and smiles if you hold "his" Iphone "in the approved manner".
All this for only $19.99. Who could resist?
