Dell heads back to court

Faulty Inspirons to blame
Mon Feb 08 2010, 14:15

TIN BOX FLOGGER Dell is set to return to court as it again faces charges that it shifted laptops that were defective.

According to the law firm that filed the lawsuit, Lieff Cabraser Heimann & Bernstein LLP, three Inspiron models were affected, Dell's Inspiron 1100, 1150, 5100 and 5160 notebooks. Problems included unexpected shutdowns, failing batteries and the inability to hold a charge. It argued that Dell had tried to hide the issues.

It wrote, "In October 2006, California customers who purchased Dell Inspiron 1100, 1150, 5100 and 5160 notebooks filed a class action lawsuit against Dell, Inc. alleging misconduct in connection with the design, manufacture, warranting, advertising and selling of these computers."

The US District Court for the Northern District of California dismissed the case and the plaintiffs appealed the decision.

Now the US 9th Circuit Court of Appeals in San Francisco has overturned the lower court's ruling that dismissed the case in 2008.

According to reports, appellate Judge Lyle Strom said that reopening the case was in the public interest. He also suggested that leaving it to customers to pursue their own cases individually was against the best interests of consumers. µ

Bout time

Does this mean that I can seek recompense for my dead 1150? Probably not, as I don't live in San Fran, but it will be great if SOMEONE is compensated for that nightmare.

Dell a strange company

Last summer I got a check from a Dell class action law suit, they don,t learn and they don't care. On one hand they have made some great computers and on the other had they have made some real trashy computers. There customer service is a nightmare, but if you get through they will come to home to fix your computer. (most but not all qualify for this)
Now they decided not to give us a driver and app cds, only the os cd. A few years ago they gave the driver cd but no OS cd.
Maybe some day they will learn that treating the customer like a customer instead of of piggy bank will pay off in the long run,but I doubt it.
