MICROSOFT HAS LOST its appeal of the i4i patent case and will likely have to withdraw the current versions of its Microsoft Word and Office software from sale.
The United States Federal Circuit Court of Appeals affirmed the lower court's jury verdict that Microsoft had willfully infringed i4i's US Patent #5,787,449 issued in 1998.
Loudon Owen, chairman of i4i, said that the ruling was a vindication for i4i and provided moral support for talented inventors whose patents are infringed.
The Vole has to comply and will change its code in Word by the new January 11, 2010 deadline but it does not have to issue a patch that removes i4i code from existing copies of the application.
Groklaw suspects that because of the trial court's large damage award of $240 million Microsoft will likely push forward a petition for a writ of certiorari to the US Supreme Court. It might then ask for yet another stay of the ruling pending that further appeal, we suspect.
Microsoft said it had been preparing for this possibility since the District Court issued its injunction in August 2009 and has put the wheels in motion to remove this "little-used feature" from its software.
Beta versions of Microsoft Word 2010 and Microsoft Office 2010, which are available now, do not contain the custom XML handling technology that's covered by the injunction. µ
They could just 'Update' their existing Word & Office suites,that way I will be quite happy,as would many other users.
They would also be complying with their decision to stop selling the current versions.
I might even consider a 'voluntary' contribution for the 'upgrade,lol.
This only goes to show further proof you can get away with almost anything if you have enough money and or power to buy high dollar lawyers and the such.

That being said, you should also note that any new version is by and large better'n the last version. It's kind of how the world works in terms of software. Who knew that Snow Leopard would be better'n Leopard, or that Ubuntu's new version was better'n their last version. Bloody shocking innit?

you obviously don't know much about windows 7 when used with server 2008 r2. Read up on BranchCache, TPM, NAP, DirectAccess, BitLocker2Go, transparent file caching, file auditing, default printers, vhd's and booting from vhd's, to name a few. And there's more.
It's not just a pretty face :-), MS really has done a great job this time around.

I just wanted to say that I beg to differ, You can certainly CAN become the biggest and richest without any real talent. You just need to be thuggish, totally unscrupulous, and monomaniacal.
Now, before you get your ultra-sensitive panties all bunched up, I am not saying they don't have any talent. I am disputing the 'reality' of your assumption that 'because you're the biggest, you're the best'.
And I believe I was saying something to the effect of what Microsoft has done for us. They've provided untold numbers of Tech Help jobs where even extremely marginal competence is enough to get you by.
Before you freak out on THAT, I'll add the 'Captain Obvious' fact that if their products are so great and bulletproof, why is the proportionate volume of support calls worldwide so high when it comes to windows as opposed to other OS's?
(Please note I have said 'propotional' here, so don't don't give us any crap about 'there's more windows boxes than other OSs'. I said proportional for that reason.)

M$ has very little talent except at dazzling fanboys with unnecessary new user interface and eye candy. Where's the WinFile promised with "Longhorn"? -- Vista is merely XP + DRM + re-arranged GUI, and 7 is merely Vista SP2 with yet more changes to the interface.
Maybe they were expecting the team of crack attack lawyers to win it.
That's one of the reasons why I, as a Tech, always recommend OpenOffice as better. This sort of thing isn't even probable in open source, since your code is raked over by a million people before it gets into the project as a whole. It's not even really POSSIBLE to 'lift' code, let alone the fact that there's just no incentive to do so in the first place anyway.
All I know is that I have to dig up, download and push this patch to an awful lot of people because of it.
If it wasn't for M$, the IT services industry would have massive attrition anyway. :p
I'm sure that the first thing they tried was to come up with a license agreement with MS like all the other companies that use the XML technology. MS fought them all the way thinking the legal costs to the small company would discourage them. I'm sure that the legal fees that Microsoft has payed to date would have covered any license agreement cost accrued to date. They knew the code wasn't theirs.
i4i should have played it smart here and instead of trying to get MS to stop selling Word (as if its gonna happen) they should have licensed the tech and got nice and rich.
Still cheaper for MS to pay than rewrite code to exclude their tech, which isnt really hard with MS' talent and money.
