McKinnon is to be extradited again

COMPUTER HACKER Gary McKinnon, from north London, could be sent to the US within weeks.

The UK Government's Home Secretary, Alan Johnson, has decided it is not worth damaging the special relationship with the US by not handing over McKinnon.

McKinnon faces a long stretch in a US prison after he was scapegoated for some of the US military's poor security in the wake of September 11 attacks.

McKinnon blundered his way through defence systems looking for proof that the US was hiding secrets about UFOs.

Johnson claimed that there was no evidence that sending McKinnon, who has a mental disorder, to the US would breach his human rights.

The fact that the US wants to lock him up for 60 years for what would probably get him a slight sentence in Blighty makes no odds, apparently.

The fact that if the US was in the same situation it would not let one of its citizens be tried in the UK makes no difference either. The US has no problem with ignoring mental illness in its legal system. Some states often execute the mentally ill and children.

McKinnon's mum, Janis Sharp, said ministers should "hang their heads in shame" for the "barbaric" decision.

McKinnon's legal team is to apply for a judicial review within days, but Sharp warned that if that was not granted then her son could be extradited by Christmas.

What McKinnon and friends do not understand is that Britain is now a client state that only is permitted to exist at the whim of the glorious North American republic.

Since we are too scared to become a member of the European Union we have to do what we are told by a bunch of bible bashing puritan dissidents, French backed revolutionaries and creators of dire sitcoms. µ

it wouldnt surprise me if the so-called 'special relationship' (remember, special does not necessarily mean good) was actually a threat of violence. or it could be a debt from WW2 that will never be repayable?

Delaying the inevitable backlash

Well, given the almost certain fate of Gary being shived with a sharpened toothbrushes in a max-sec prison, that might actually end up being the drop to spill the glass and make you wake up to what "special relations" are. I am quite certain autistic hackers get the same treatment in the prison as do child molesters, cops and corporate executives. Bottom line, if you feel bad about extraditing you citizens to a foreign nation, how would you feel about him getting killed in prison afterwards and can't the home office really see this happening together with the domestic backlash?

The only ones this sucks for bottom deep is Garry who'll be dead and of course his poor mom.

I've always been an Obama supporter.

But the longer he stays in office the more I see nothing changing. His health reform, even if it passes, is a joke and the corporations are stronger today in controle of his country than even under Bush.

McKinnon, G_D bless him, may not be innocent but he's hardly a dangerous criminal. Obama would have done best just to let this case slide into silent oblivion as he has done with the crimes committed by the prior administration.

The UK needs to re-find its' self respect and fast.

Actually, I'd say he's the victim of his own actions.

If my 14 year old son steals his 17 year old sister's diary from her room, it's well within my rights to punish him, "in-house". It affects no family but mine.

If he goes down the street to the house where our local Sherrif lives and steals his TV, and gets caught, there isn't much chance of keeping the punishment "in-house".

And yet, you act as if this is not the case...

He attacked the computers of a foreign government that has an extridition treaty with his country. It's really that simple.

He was looking for UFO information. Looks like he's going to find out that in an american prison, "UFO" stands for his "Unlubricated F@#ked Orifice"

About time

McKinnon is just a scumbag hacker who got caught and now he's going to prison where he belongs. This should be a lesson for other hackers. Alleged arsewipe syndrome is not a get out of jail free card.

And this is a backseat issue compared to the complaints over the way america is being exremely heavy handed over this. As has been mentioned, would they send the uk an american for trial at all, much less if we were going to up his sentence by an order of magnitude.

Britain is in charge of all the money, but the US is in charge of human rights. Is that how it works?

Regardless of whether or not Jorge was being "politically correct", he was correct. Many famous people who suffer from Asperger's Syndrome have been able to travel extensively. This was McKinnon's defense against extradition, afterall. Not being able to travel because of his "illness"...

Which is more politically in-correct? Jorge making a play on the name of an illness, or insulting all sufferers of the disease by trying to co-opt it to avoid being punished for a crime he is guilty of, and has admitted to? It takes a pretty despicable person to do that, in my opinion.

Additionally, on my way to work last Tuesday, I passed a State Trooper who was traveling in the opposite direction while I was doing -well- over the speed limit. As soon as I saw him, I slowed down and pulled over because "I knew" I was caught.

The fact that I pulled over before the state trooper was able to turn on his lights/siren and turn around impressed the trooper so much that when he arrived at my car he was still trying to come up with something to say. What did come out after I greeted him by admitting I was speeding was "Wow. I never saw anyone pull over before I could get the siren on." His next sentence was, "Keep it under 70mph and have a great day".

No citation. Point is, if you nut up and accept responsibility for your screw ups, things in life tend to go better. Why mention this?

As has been mentioned in past articles on this site on this very subject, if Gary McKinnon had shut his fat mouth and just owned up to his crimes, he'd have already been extradited, sentenced -AND- been out of jail after serving his sentence. Let me repeat that for you. If he'd accepted the original deal, taken responsibility for his actions, and agreed to be extradited, he'd already have done every, single day of his original sentence.

I have no pity for him.

So,it's alright for McKinnon to be sent to America & convicted,along with an excessive sentence for sitting at a keyboard?
What about this bunch of shits,that call themselves government ministers?

They have passed laws that enable YOUR state to hack into YOUR computers,'private' telephone calls,emails,health,criminal,social security,tax records & umpteen others
besides,is that okay with you,because
you see, they were elected by a 'minority' at the last election,so that makes it okay does it?
If that's not enough,would you be comfortable, knowing that, it's not just YOUR government that has access to ALL your 'PRIVATE' data, but also the USA & any other state?

Pure Injustice

In response to another comment, I doubt we owe anything to America for WW2, they were happy to trade atomic technology for our expertise in biological warfare and neurotoxins (far more effective than an A-Bomb), not to mention Germany were building the first jet engine based planes that could reach them so far away.

On the point of hacking, I disagree entirely with comments about punishing out of house because a foreign computer was hacked. The internet is not so simple, we provided him with access to another country's computer without making it clear that he was in foreign territory, no welcome to America signs no passport control, it is easy for someone to be unappreciative of location on the internet.

Furthermore, even if on principal it is found he should be extradited, we should know better than to hand him over to a justice system that does not factor in motive, mental state or their own incompetence. Those tens of thousands of dollars in damages would have been the costs the DoD incurred hiring Windows 2000 experts at extortionate rates to research that hacking attempt, ultimately to tell them that he's harmless.

Furthermore asperges disorder is serious, I teach kids who have it, it's not just some half hearted mental disorder, they seriously lock on to things and rely on obsessions, sometimes almost to the level of autism.

I would argue that Alan Johnson should be sent to jail for playing with someone's life in such a callas manner.

Of course, it's all about the oil though, even though there have been significant developments in renewable energy resources, the government is always the last to catch on.

Don't sign the treaty then

If you don't want to abide by the treaty, don't sign it. I'm just glad that the UK still hono(u)rs its agreements as it should. It's not about "special relationships" or "American hegemony"; it's about operating within the law, whether it is popular or not. If the UK were handing over this hacker with no treaty in place, *then* there'd be a "special relationship" going on.

Likewise, McKinnon is going to have a trial under a court of law. He can make whatever autism arguments he wants again in that trial. Hell, I wouldn't be surprised if he gets off with a lighter sentence too.

Scapegoat?

A criminal commits a crime and may go to trial for, and may even suffer jail? Oh horrors! If he's capable of determining right from wrong and making a decision based on it, he can be found guilty. If not, then he and the rest of the world need to be sheltered form the consequences of his mental illness without malice.

I'd be ok with Britain trying him, but I don't see what the problem is with extraditing him since the crime is against the American government. If the underlying issue is that you don't like America, just say so and keep McKinnon out of your prejudices.

McKinnon is less a scapegoat for America than a convenient target for your ire against America.

@CompEng - Don't change the subject. No one is bashing your country without very good reasons.

I would love to see the myriad of American spammers judged and jailed in all countries of the world where they commit their crimes, but as I know very well it won't ever happen, and it would be an physical impossibility, I just believe to be fair that Mckinnon must stay in his country and answer for his crimes there.

Most Americans are pissed because a third grade cracker succeeded to expose how USA were incompetent at that time.

I'm not sure that no one is bashing America without very good reasons.

Points of contention
1. Not backing down on extradition:
America is within its rights to ask for it. They should be willing to negotiate, but asking for extradition is a reasonable starting point.
2. Asking for over-the-top punishment (60 years, someone quoted?)
I'm not familiar with the details, but standard procedure for prosecution is to ask for a lot and then make the defense and jury pare the punishment down. In our adversarial justice system, prosecution rarely gets anything like what it originally asks for. They're simply making noise publicly to deter other hackers.
3. America is being insensitive to the plight of someone with Asperger's disease
Perhaps so. But on the other hand, some societal deterrent is required to keep those capable of causing damage from doing it. If you're capable of doing harm, you must either be responsible for yourself or someone must be responsible for you. There are no other viable alternative.
4. No extradition to a country with a reputation for torture
Name me a country involved in a serious war against an entity with which there is no treaty regarding the treatment of combat personnel or civilians, and yet no one in that country has committed any torture. That is not an excuse: torture is unequivocally wrong. But I think the idealists complaining here lack broad perspective. As in most things, if the concerned here were a little more familiar with the normal proceedings of the US criminal justice system, they might have less to fear.
5. American internet kiddies are obnoxious
I offer no opposition on that point. The internet has been an idiot's playground for years.

Are most Americans pissed about the incompetence of their government agencies? Perhaps. Many are pleased, because it validates their worldview that government is incompetent by definition. Myself, I'm happy that it was McKinnon that pointed it out and not some more malevolent party. But that doesn't mean America can afford to take the full responsibility on the issue. Millions of script kiddies can knock down almost anything if given free reign.

I just think all the vitriol is unwarranted. Maybe it helps people feel better.
