Suckers never die, they just exchange places with each other - A proberb
THE UK'S TOP Internet service providers have opposed Business Secretary Lord Peter Mandelson's daft plan to cut off persistent illegal filesharers' Internet connections.
Talktalk has even said that it feels the scheme infringes upon people's rights and it will be happy to go to court to have it struck down.
The second largest Internet service provider in the UK, which owns Tiscali and AOL, has said that it is not afraid to undertake legal action against what it calls a "guilty until proven innocent" approach that is, in its view, "wrong-headed and naive".
"The approach is based on the principle of 'guilty until proven innocent' and substitutes proper judicial process [with] a kangaroo court," said Talktalk executive director of strategy and regulation Andrew Heaney on the company's blog. "We know this approach will lead to wrongful accusations."
The Internet provider rightly points out that Mandy fails to take into consideration that illegal filesharers can use other people's Internet connections over unsecured WiFi links, leaving innocent people potentially vulnerable to false accusations and possible disconnection.
British Telecom also slammed the decision. BT Design's managing director of innovation and strategy, JP Rangaswami, said on his blog, "What a shame. Britain could have led, should have led, the world in a complete rethink of the principles, practices and legislation required for a thriving digital world. Instead, we're about to take ten steps back."
Ben Bradshaw, the Culture Minister, said last week that file-sharers wouldn't be disconnected "willy nilly" and would have the right of appeal.
However, having a right of appeal against a penalty based on a wrongful accusation is no comfort. Such false accusations should never be made in the first place. µ
It's nice to see ISP's working with their consumers for a change.
I truly congratulate them on this move.
Laws are always the thing politicians fall back on when they fail to find another way to change people's behavior. It is the cowards way out, and will likely be ineffective at changing people's behavior.
People download music because mp3s are still ridiculously expensive considering the massive reduction in costs brought on by the digital revolution. People will only buy a certain amount of music, because they have a finite budget to spend on music. But why shouldn't they get 10 times for for their money, now it costs 10 times less to deliver it?
People download movies for the same reason, and because films are release one place and people in another place want to see them.
The world is not made up of thieves. People are happy to pay, provided the price is fair, and the product is available for sale. If this is not the case, people will do something else.
are busy dismantling proper judicial process. This is important for them as it allows "guilty until proven innocent". The americans got rid of theirs when they invaded iraq, france and britian are now eager to follow but unlike the americans that came up "terrorism" as an excuse europe seems content to dismantle its legal system for the sake of a business so small it doesn't even count as a single percent of gnp. This ought to strike anyone as odd, at best, and downright evil at worst. Make no mistake, they may remove the legal rights of "fileshareres" or "pirates" or whatever they choose to call it, but once that is done there will no longer exist a judicial process for anyone. The legal system will become random, economized and politized, a tool used by the powerful against the weak. And while some may argue that is already true at least on paper the judicial process exists now -though, in the name of "terrorism" all governments have been busy dismantlig the judicial process. In america only a hollow shell remains, in europe we haven't gone all out yet -and now, to protect a tiny entertainment industry, we're going to throw our humanity away. For the fucking *entertainment* industry.
It's so absurd I don't where to begin.
Mandelson should return all the cash he has skimmed from the public purse before he can take any kind of legal or moral stance.
Then he can fuck off, sideways.
As a music lover and musician myself I love mp3s compared to having CDs scattered all over the place but the governments idea is stupid typical of Gordon Brown and his clowns. Yes we need to rid the pirates that are downloading 100s of illegal files but this is not the answer. I have purchased many mp3s myself from Amazon and Tescos very reasonable price under a pound is ok by me they are very reasonable and you can burn them to CD etc for the car. Its also better than buying a full CD when all you want is one track or two so it works out much cheaper and more convenient too.I think closing down the sites that are distributing illegal mp3s would help and thiers plenty of them out there not just in the UK but places like Russia and Germany for instance I know this cause a musician friend informed me that these sites were distributing our music illegally.
It's all bollox - nobody gives a rats arse about anything it seems.
There's a forum about this, a commitee about that, MP's talk shit all the time - not some of the time, ALL of the time, we hear that this will be done, that will be done; but in reality, the backbone of society (people who work) are the only ones who are being "done".
MP's are nothing but arsewipes, and any of the fuckers that deem to say that the internet is under their control should be fuckingwell fired and made to live on an average wage, and by the way, Mandelson means absolutely fuck all to me, and every single person I know.
Hats off to Talktalk Andrew Heaney.
I'm tired of all the witch-hunts.
I can't get my treats for getting tricked. Why do they castigate the innocent until proven pope?
I'm stayin home for Halloween, because the mean people suk.
- but has his rights to appeal. What wrong with that Mandy? If Mandy and his deep pockets win, then whole “media-against people” saga will not be different to executions by commies and other dictators for minor issues. Also, any public library with collection of CDs and DVDs and any other public venue will become illegal, due to possibility to exchange files using USB stick and so on. Spying on all people connected to internet will become a normal procedure to find if any particular person did anything wrong (easy job these days, - right?), and we can kiss goodbye all freedoms we have.
"If this is not the case, people will do something else."
Summed up perfectly!
These Digital Nazis and their lackies are going to legislate themselves right out of existence.
Get it straight clowns:
You're just another distraction.
You don't hold the keys to the meaning of our existence.
We watch/listen to/play with your stuff because it's there and we're generally bored at the time anyway.
If you go away we'll probably miss you for a short while but I can promise you none of us will be reaching for the razor blades once you're gone for good.
We'll find something else to do.
It's as simple as that!
Heres intresting story, if your intrested in coring way thru wall:

really it comes down to "what is an isp for?"
In the myriad of sub-answers to this question one thing becomes plain. ISP's were originally ONLY to provide transit - or bandwidth and connectivity. With the commercialization of the net [very natural] and the incestuous relationships these companies have with each other, and against each other one thing seems to have been forgotten:
when an isp does ANYTHING but provide transit and uplink we open ourselves to a situation where the selfsame ISP benifits by NOT providing what it was contractually oblicated to do so. And as more and more regulations are passed by people who cant change the oil on their cars much less debug code, the less chance we have of "measured, reasonable, and easily understandble" limits to the legal liabilities we all face, both as consumers and as providers.
It is also therein that net neutrality should live.
the real victims of music piracy are not the artists, they get about 5-10% of revenue so they only suffer 5-10% of the debt.
mandelson is protecting the remaining 90-95% income of the faceless corporate fatcats.
the business of music is like any other, it has been streamlined into a production line of profitmaking and the people who should be paid well are not.
its backward and therefore cannot be used as an argument against piracy.
mandelson should just spit it out and admit that government acts on behalf of corporate industry first and people second. (when its the people who fund the country and his wages!)
if they actually lobbied for lower prices then this would have a positive impact on the situation and they would not generate unpopularity.
if his twisted plan comes to fruition, i would urge everyone to stop buying media products and let the industry dissolve (into the putrid mass that it really is) as a victim of its own greed.
meddleson is a parasite on this country's face, feeding misinformation to the senses - garbage in = garbage out
The link between my real address and my IP address is only known by the ISP, so are they going to be legally required to give this information to a third party (Big media) under the Gov proposals?
Business secretary, Lord Mandelson, needs to be very careful whom he threatens as this might have very serious ramifications.
The entire Digital Platform High Capacity Control System is controlled via an illegally ‘STOLEN’ and illegally deployed program in breach of all signed contracts.
The British Government have no right to use the program or take revenue from the use of said program. All contracts that were made are in fact illegal, as you cannot sell licences to use ‘Stolen Copyright Protected intellectual material’.
I formulated the program and designed the super controllers.

What ever happened to the audit that found every member of Parliament had misappropriated funds?
Every MP!
But they don't go to prison or even lose their jobs because they're connected.
One law for the rich and another for the serfs.
It's long past time to have 2x for law enforcement and 3x penalties for guys that write the laws.
