Jobs pressured Palm on 'gentlemen's agreement'

APPLE MESSIAH Steve Jobs attempted to get Palm to accept a 'gentlemen's agreement' that the PDA maker would not poach his staff.

Former Palm chief executive Ed Colligan discussed the matter with Jobs in August 2007, as the smartphone war heated up. According to AP, he rejected the proposal, calling it wrong and "likely illegal".

The problems began when Palm hired a former Apple executive, Jon Rubinstein, to develop new smart phones. Jobs was worried that Rubinstein was recruiting Apple employees who had previously sold their souls to him during orgiastic blood rites conducted in Cupertino's personnel department.

He said that both companies should work to stop Rubinstein populating Palm with Apple heretics who had renounced their black turtle-necks. We guess Jobs wanted them back for appropriate reprogramming or at the very least a pastel inquisition.

Apparently Jobs threatened that if Colligan did not do his will he had much more money than Palm and would win any legal fight.

The conversation did put the fear of Jobs into Colligan who said that he thought about Jobs's proposal and considered offering hiring concessions, before deciding against it.

We would have thought any gentlemen's agreement required both agreement and gentlemen. But Steve Jobs is a god so automatically exempt from such mortal considerations.

Jobs' comments have come back to haunt him as the US Justice Department is very interested in how tech companies are trying to lock in staff with bizarre employment contracts.

Derick Mains, a spokesman for Palm said the company had not been contacted by the Justice Department yet. µ

Wow Nick, sounds like YOU should be working for Palm. "Poaching" or stealing employees is just like cheating. If Palm can't come up with their own ideas for PDA phones, then maybe they should choose a different market. Maybe you should take aim at the Microsoft monopoly.

HAHAHAH!!! What fantasy land are you living in. That's business, if Apple can't afford the best talent, it doesn't deserve it. And only an Apple zealot would see this as a bad thing, customers will benefit from more competition in the market place.

Nick, this is your best yet!

By the time I finished reading the article I had almost wet myself from laughing so hard. ROTFLMAO just doesn’t do it justice. Nick, so many of your anti-Cupertino tirades are over the top with relentless bitching, but this one is spot on with just the right amount of humorous irreverence that the mighty McGeek championed when he created the INQ. and who should be proud of this diamond IMHO.

OK, sorry everyone but I just have to repeat the gems here for effect.

are u dumb thats what a company dose when your creative team isnt creative any more you fire them and hire new ones.../

u do relize that steve jobs dosnt design all the apple products... he has a team and he just approves them. palm isnt one person its a corperation you f*&king ideoit(sp)

There is a joke there somewhere...!

If Jobs is having to go bullying Palm then Apple personnel dont have their employment contracts suitably worded do they?

Many such knowledge critical professional contracts should stipulate a perios of gardening leave etc on pain of loss of golden handshake on termination.

Maybe Jobs isnt paying them enough to exert that kind of influence!?!

If word on the street is true...

I've often heard that while Apple pays well they own their employees' souls and works them to death. All Palm had to do is offer equivalent pay and treat the employees as humans and Apple employees would come running. And what's up with some people thinking that employees are property? Um, hello? They are free people!

On topic:
As far as contracts go: no contract can prevent you from earning a living. One can stipulate in a contract, a set period of time that an employee has to wait between the time of resignation and officially not working for the company. For example one week for every year of employment. This time is time must be payed in full.

Off topic:
Nick, this article is very funny. I can’t believe that some people left comments that they did. Hard to imagine that anyone who can read and write does not get sarcasm and humour?

Seriously people, Apple has an advertising department who gets reports from all over the internet and newspapers and reports back to him. If anyone who would have any problems with Nick, it would be SJ and you don’t hear him complaining.

While I also disagree with AirForce1, I also think you could learn English - you might find that people start taking you far more seriously. Just in case you are curious, you might be interested to know that your first sentence contained no less than eight major mistakes, and your second contained no less than 16 - that's a grand total of 24. Counted over 54 words, that is a level of English I would honestly expect from someone who is mentally disabled. We're all human, and we ALL naturally make mistakes - but nobody makes 24 in two sentences!

It IS also true that there are some geniuses out there who write like retards, however, the correlation between IQ and a person's standard of written English is high enough for most people to read your post and mutter "Idiot." under their breath.

Do yourself a favour, and learn how to spell. You can start with these words:

Then review your apostrophe usage. You obviously have no idea.

Completely illegal in California, along with odious "noncompete" agreements.

In California, employees are kings of their own destinies, free to choose new jobs as they appear.

Ironically, if Apple and Palm had agreed to Jobs' illegal no-hire offer a year or two earlier, the iPhone never would have happened. Apple hired numerous Palm engineers to develop the iPhone and its core software architecture.

More than likely. Apple's pay is, in my experience, not significantly higher than the Bay Area's averages for comparable fields but the stresses of the job -- including Apple's notorious culture of secrecy -- are far higher.

If Palm can't come up with their own ideas for PDA phones, then maybe they should choose a different market.<<

Considering that Apple itself had hired away a very large proportion of Palm's own engineers to develop the iPhone, this is a rhetorical tack that the iCultists would be best advised to abandon posthaste!
