A BLOGGER who failed to hand over her computer for inspection in a defamation lawsuit was jailed because she refused.

According to the Houston Chronicle, Lyndal Harrington, who wrote for the Web site Rose Speaks, is being sued by Virgie Arthur, the mother of the late Anna Nicole Smith.

Harrington claims that her computer was nicked. Apparently her house was burgled a week after she was told to produce the PC so it could be searched for evidence. But District Judge Tony Lindsay does not buy her story.

Harrington was jailed for contempt but later released so she could hand over the computer by July 2. She still claims that she cannot turn over the computer to the court because she simply doesn't have it. µ

All the layers, judges and policemen actually working on this ridiculous case!

Why is a little bit of pathetic blogging taken so serious that a lawsuit has to be created out of?

First Amendment

While the first amendment does grant people considerable freedom to say whatever they think, it does NOT protect the speaker in cases where they are willfully publishing false statements. Having not read this blogger's comments I can't say as to whether she was guilty of defamation. At any rate I am still amazed at the number of lawsuits that have come from Anna Nicole's original, and frivolous, estate claim against the Marshall Family. She fought that claim somehow for 14 years until her death and even now it is still picking up a variety of other lawsuits on the side. Her ridiculous actions have probably provided for one of the most litigation heavy issues in a very long time.

The Magical Coputer that Disapears and Appears Again?

Just a second here, did the judge order a search warrant at the alleged location of the computer? If he did not, he should at least think that the timing of a disappearing computer would indicate and worth investigating a frame job especially if the computer reappears with the so called evidence in the machine, either possibly put in the machine by them in full, or a little deleted by the framers to make it look like the owner of the computer would have attempted in hiding something.

Also would the computer arrive when found fully cleaned of fingerprints? Would she really thought of that one? Even though it would still be her computer, right? NO! I suspect the courts here are fishing or manufacturing evidence or for evidence that is manufactured by a third party, as we speak. It smells of it.

There is also a chance that another party stole the machine with information in it that would incriminate that third party.

This is always a danger when you let someone else, no matter who, use your computer.

And where are the laws on personal opinions cannot be used against the owner of these opinions even though they somehow get mistakenly published or out there?

That would amount to litigation against a frame of mind. A computer is a storage device like any brain is, like it or not.

I argue, if she actually did this, why would she go to jail instead of offering an apology or restitution? To me that says she does not KNOW if any in the computer what the evidence is!

The Hypocrisy of the law also would have her to incriminate herself? What is going on here?

Liquidate them all, I say.

I say line up everyone involved and liquidate them for annoying everyone with their pathetic, useless lives.

That's how I used to handle things in the old Soviet Union. Kept things running smoothly, that's for sure. Then when Nikki (Krushchev) took over, I knew then things were going to go downhill. When Lenny (Brezhnev) got "elected" General Secretary of the party, well, I just threw up my hands (and my lunch) and walked away. Even Mephistopheles thinks that was a bad deal. Buncha damn sissies, all of 'em, no stomach for doing what needed to be done to keep the West at bay. I always felt that nothing like the threat of liquidation could keep people working hard, even if it was on something totally meaningless like Bolshevism.

The REAL Truth

Lyndal was jailed for contempt for failing to turn over her hard drive, not for staging a burglary. Lyndal said she couldn't turn her computer over because it was gone.

When first asked to turn it over, Hurricane Ike destroyed her home and the PC was sitting in four inches of water. It took 3 weeks for her electricity to come on. Soon she moved to a new home.

Lyndal thought the PC was dead, but later figured out only the monitor had died. She was planning on turning her PC in when the house was burglarized.

She had no car, so the driveway was empty. The houses immediately surrounding hers are vacant and up for sale.

She worked the 3rd shift the night before and was in a dead sleep when the break-in occurred. Her bedroom is furthest from the door the burglars broke into.

Ms. Harrington never told anyone two weeks prior to the break-in that it was going to happen. Mr. McCabe’s surprise witness made up that story and it can be proven along with other accusations that this witness lied about.These lies are now being carried from site to site by Mr. McCabe supporters.

Two months, NOT TWO WEEKS. Several know about the set up break-in not just the witness. Emails can tell a lot. Nelda (Roseblabs.com) helped plan it.

Lyndal is a trash stealer who is nothing but evil. She may be charged with stealing mail. She lied to a judge is why she went to jail. July 2nd she may find herself in jail again if she don't try to find that computer. Lyndal even refused to look in pawn shops for the stolen computer.

court has no right

whether she lied or not about the pc being stolen, the court has no right to steal her pc. Legally without a warrant, you can shoot a cop when they refuse to leave your property but in Montana, a jury will let you off if you shoot the cop when he has a warrant.

At least a jury with me on it will. :P

No sympathy for her here

Lyndal had months to turn over her emails and other electronic communication before the computer was ever ordered. She refused to comply with any of the court's orders. Then the "breakin." She deserved to go to jail. Her trash stealing to gain "dirt" on anyone supporting Virgie Arthur and laughing and joking with Art Harris about it, going so far as Art Harris calling her his "sin sniffing" dream girl, or some such sickening nonsense show how low these Howard K Stern supporters will go.
