Tessera beats up chip makers over patent

Motorola, Qualcomm, Freescale and Spansion rumbled

THE US INTERNATIONAL TRADE COMMISSION has issued a cease-and-desist order against Motorola, Qualcomm, Freescale Semiconductor and Spansion on behalf of Tessera.

The order demands that the chipmakers stop importing into the US small-format semiconductor packaging products which infringe on Tessera patents.

Tessera, which develops miniaturisation technology for electronics makers, had asked the ITC in December to consider banning imports of the packaging products.

As a result of the ruling, Qualcomm has arranged to flog the chips sourced through a licensed US supplier, Amkor, so it does not get itself banned.

Qualcomm also hit out at the ruling. The patents will expire in 2010, and in any case Tessera's patents are being re-examined by the US Patent & Trademark Office, it moaned. µ

USITC Not A Court

This USITC thing is a great scheme, isn’t it. They aren’t a court, they don’t have to follow any judicial process, so if you can’t get a sympathetic judge to give you an injunction against these pesky competitors, just go to the USITC and have them issue a ruling.
