Apple says others are behind Psystar's misdeeds

Will make them pay
Thursday, 4 December 2008, 09:30

APPLE FILED a motion on Tuesday to amend its complaint in its lawsuit against Psystar.

Psystar attracted Apple's lawsuit by selling unauthorised clones of Apple brand computers.

The Cupertino-based fount of über-sleek but overpriced and hermetically sealed computers, pocket music players and touchscreen mobile phones wrote to the US District Court for the Northern District of California in San Francisco that it wants to add new claims, including one for violation of the DMCA, and enlarge its existing claims in its lawsuit against Psystar.

In its Amended Complaint, Apple said it believes others put the clone maker up to its tricks, and it wants to find out who they are – through civil litigation discovery – and sue them too.

The title of Apple's Amended Complaint against Psystar, and now others, reads as follows:

AMENDED COMPLAINT FOR COPYRIGHT INFRINGEMENT, INDUCED COPYRIGHT INFRINGEMENT, VIOLATION OF DIGITAL MILLENNIUM COPYRIGHT ACT, BREACH OF CONTRACT, INDUCED BREACH OF CONTRACT, TRADEMARK INFRINGEMENT, TRADE DRESS INFRINGEMENT AND UNFAIR COMPETITION

All of Psystar's counterclaims against Apple have already been dismissed by the court, and Psystar stipulated to Apple's motion to amend its complaint because its lawyers apparently saw no hope of opposing that.

Psystar is now like a mouse at the mercy of a very angry cat.

If others yet unknown are implicated in discovery, this case could get even more interesting. µ

Apple Should Be Happy

Ya' know folks Apple should be happy that someone wants to load their OS on some up to date hardware. The other day while in Future Shop I was looking at the system properties of a large screen expensive iMac.
I saw a slower Core2 processor, 2gig's of ram and AND ancient 256mb ATI 2600pro graphics.
To each his or her own but $1800 plus taxes for this this polished turd? Hum, no wonder Apple is so sensitive over this issue. I don't want to annoy Apple owners but your being taken by slow outdated hardware.
Well at least IMHO anyway.
