French music industry wants P2P ban

And the Internet switched off

THE FRENCH MUSIC industry has decided to sue four US-based companies that develop P2P applications, including the BitTorrent client Vuze, Limewire and Morpheus.

They are also hoping to switch off the the open source development platform SourceForge for running a fourth application called Shareaza.

Société civile des Producteurs de Phonogrammes en France (SPPF), an umbrella group for several French record labels, claims that the four file-sharing applications help software pirates.

Although the companies have nothing to do with copyright infringement, SPFF believes it has a strong enough case to shut them down and eliminate P2P completely.

Its argument is that Vuze and the others are knowingly distributing software with the purpose to permit unauthorised access to copyrighted works. Since everything, or every application which allows a user to share files, will be used for illegal purposes, they are culpable.

Now it seems that a French Court has decided that the four companies can stand trial in France. This is partly because of new French legislation which demands all P2P applications must have a feature to block the transfer of unauthorised copyright works.

Since such a filter is impossible, SPFF is claiming millions of dollars in damages for lost revenue.

Going for SourceForge for hosting P2P software is also a bit bizarre. Ironically it could mean that the Open Source movement grinds to a halt because of the Music Industry's obsession with copyright.

It would also kill off company's like Skype which are based on P2P software. It would also mean that they could legally shut down the Internet for perpetuating piracy.

After all if there were no Internet there would be no P2P piracy. µ

Idiots

That's like suing Beretta because someone used one of their guns to commit murder.

While they're at it, they might as well sue Microsoft, after all Windows Live Messenger can be and frequently is used to exchanged copyrighted works.

Oh, and anyone who provides any kind of email service with attachments, too.

Claiming Jurisdiction Over The Internet

So, the French are claiming their law applies over the entire Internet. Where did they get that idea from? Did they copy it from someone else who was already doing the same thing ... like ... the USA?

I still wonder...

i still wonder why they didn't rollover FTP protocol as this is so "FILETRANSFER PROTOCOL"... Haven't seen any FTP blocking copyrighted materials either. Go get them boys...

It's just a matter of time they will sue air for transmitting music to everyone for free.

No. As a French, I can testify that i'm personally consterned and that 85% of the population is against the new Internet & Copyright bill. French websites and forums are crowded with angry reactions. It's like another national embarassment.

They want to shut down the internet, yes there is no crack here, this is really true, they want to shut down Internet, your Internet 
The new bill is just allowing them to shut down your internet line for up one year (plus still having to pay for the due subscribtion ) without even a court decision, just when being targetted by music industry private watchdog.

There is no such thing as a french popular support on this. But nothing smart from the governement and from the state is going to come before years.

The french have been dumb enough for electing their own little Bush.
Mr Sarkozy friends are not into Oil, they are in the entertainment industry, televisions, press groups, telcos, Internet Providers...
His own brother is a high ranked executive in the Carlyle Group, owner of the one and only cable national network ...
A number of very stupid bills are not yet released but may appear very soon including limitation of upload speed, forced autodestruction of non certified anonymous content in blogs and everywhere, absolute filtering a la chinese.

WTF?????

That is ridiculous! You could use that same argument to say that hard drive manufacturers should be shut down!

I came across this article from the rss feed on my gmail... the next article on the list was entitled "French sheep breeders take flocks to Eiffel Tower"! God bless the French - always good for a laugh!

Another bunch of nutters

With the usual, old, arguments.
If aiding piracy is your problem, then start by rereading the court decisions over VHS tapes - it's all been done before and just because we change medium doesn't mean we should have to go through it all again.
Just because something can be used to aid piracy doesn't mean it is only used to aid piracy etc etc.
More quality proof that France does everything the US does, only a decade later.

Copper

I'd go after mining companies. Copper is used in almost all piracy cases. And I would be damned if the companies don't know that. They do, and they defiantly keep mining the stuff, because they are profiteering from the ever-increaseing demand for bandwith necessitated by the digital piracy.

Where do we stop...

They ought to sue microsoft and all the linux distros as well for enabling the running of P2P Apps. 

And the hardware companies for supplying hardware enabling the running of the OS.

And the electric companies for supplying the power for running the hardware....

Apropos FTP

At US DOE research centers FTP is already being blocked, both ways! With a few exceptions. US ISPs will follow, that I promise. And access to the Usenet was cut by DOE many years ago. US ISPs just followed suit. P2P would make sense, we have plenty of data to transfer, but the MAFIAA says no, so no P2P here either. Grid computing? Ha, ha, all dead, only good to get a bit of funding (you know, re-search as in "search again", for money). Actually we cannot even copy files between computers from office to office either. Security, sure. Our Internet2-based communications is throttled to a few hundred kB/s now. Seriously. Millions of dollars went into Gbit/s connections, and then the whole thing was brought to an end with firewalls. Just wasted. I have more, but got to stop. Makes me feel too sick.

Internet Providers

Why aren't internet providers never in the equation? A while ago we had dowload limits.. about 40GB a month was already too much.. I mean for legal products. If you spend all those 40 GB on Itunes.. you would have a about 20,000£ bill at the end of the month.. These days, there's no limite... Somenone ir profiting with piracy... And this someone are the internet providers... "Get faster and better, no limite internet connection for 10£ a month"... these are the actual piracy contributors.

Well...

How about going after the French postal service, as they wouldn't stop me from sending mp3s across the border either.

And Ford for not doing anything to stop me loading a car with USB sticks full of mp3s, and driving it across the border...

And the French border patrol, which as anyone from the UK knows, couldn't stop a bus load of illegal immigrants crossing the border, even if they had a neon sign saying "Illegal" on the roof. A bus load of pirate music would be childs play to get past them.

French Fries

I like French toast but seriously, WTF is this nonsense?? Last time I checked, the only French music artist I could name is "Alizee Jacotet" who is heard over over here in the "Ex- Colony". While she is quite talented and very delicious to the eyes, I can't imagine the French Record companies would be making such a fuss over just one artist's works. The French can't shut down the entire Internet, let alone completely block access to it for their entire country. They'd have an easier time suing every restaurant on earth who serves "french fries" on their menu.

A Simple Solution

Since the specific purpose of the world-wide web is to facilitate file sharing, clearly it cannot be made compatible with French law.

I therefore suggerst the French legislators ban all French people and companies from using the web, leaving the rest of the world in peace.

Who Cares

Does anyone outside of the French really listen to, or care about French music? If it isn't in English who cares. I can not imagine that there is a large market for bootleg French music shared over P2P. If it is really good music then people should just purchase the song(s).

You know RG, the french solved an issue with a small group of assholes messing with the population before, how about the people look up the buildingplans for the the good old fixer-of-heads while you still have internet?

What I wonder if sourceforge need even bother defending, they can just ignore it since they are not a french group under french rule, let the french cut off internet/sourceforge and by doing so shoot themselves into the foot, or face even.

France should try to sue FM radio too.. it's free and distributes music available to convert into mp3 files using $20 pm players..

food for thought

If P2P becomes the norm for music consumption how is the music going to be produced? There's a food chain of talented hard working people involved in every quality recording enjoyed worldwide. When the product no longer generates revenue how are the craftsmen and women going to make a living? With no money to produce a product the product ceases to be produced. Simple economics. The finger is always pointed at the Fatcats running the majors but they are but a small piece of the pie.

Get rid of all the music companies and you will see more and BETTER QUALITY music. The idiots running the music business are the only ones who benifit from stupidness like this. Let the french hang themselves, there will always be some country willing to host "illegal" web sites, and there will always be technology that can get around their idiotic laws.The countries that try this kind of thing will be left behind to the extent that they are successful.

The filter, why not?

Actually the filter is not technically impossible. But it would require a lot of voluntary work. For example a registry could be set up so that all copyrighted material can be identified (CDDB-like), therefore statitistics and sampling can be used to determine when where and who is uploading and downloading this material. In my opinion though, instead of shutting up access with such a filter, it could be used to set up a compensation payment system akin to what is currently used for radio, so that ISPs could share the money they make off all that content and all that file sharing could become legal.

this has got to be one of the most stupid things i've ever heard about... If the French want to stop file sharing in their country, they can go unplug themselves, no one is going to miss them... 

But suing SourceForge is taking it too far... it's a major player on the Open Source community, and shutting it down could do a lot of damage...
