McKinnon's fate decided on Obama day

THE FATE of Pentagon Hacker Gary McKinnon will be decided by a UK judge on the same day that Barak Obama is inaugurated as president of the United States.

The UK's High Court has set 20 January as the day when it decides whether to grant McKinnon a judicial review, his last legal recourse against extradition to the US where he will face hacking charges and a possible 60 years in prison.

McKinnon's supporters see the coincidence of his hearing with Obama's inauguration as a good omen. They think his hacking charges were trumped up by a Bush administration hell-bent on vindictive justice. They think that under Obama, justice will shine a favourable light on Gary's case.

"Is it just a coincidence, or are the officials who set the court dates waving a couple of fingers at President George W Bush and his... henchmen, who officially hand over power to President-elect Barak Obama on the same day, Tuesday 20th January 2009?," reads the website for Gary's campaigners.

Obama's arrival is being anticipated like King Arthur's awakening from his sleep at Avalon. But it won't do Gary any favours if his application for a judicial review is thrown out on the same day that the world's media is celebrating the Coming of the King.

With his legal recourse running thin, his popular support will be all his campaign has to fall back on. The opportunity Gary has on 20 January is elaborate: The High Court has agreed to allow Edward Fitzgerald QC, a renowned human rights lawyer, to make an oral application for a legal review of the decision taken by Home Secretary Jacqui Smith not to reconsider Gary's extradition order after his diagnosis in the summer with Asperger's Syndrome, a psychological condition that will make it hard for him to bear the pressures of incarceration.

Fitzgerald had already made a written application for a judicial review on 17 October. It was refused. The oral application is not likely to differ in substance, but is allowed on the basis that an oral representation to a judge can be more persuasive.

If his application fails, Gary will have no other way to secure a trial for his hacking charges in the UK bar his popular campaign. It is fitting then that Gary has re-launched his popular music video after Myspace removed it last month.

Ignorant of Justice (Not Asp...)

To the folks explaining Asps disease... did the disease cause him to commit the crime he is accused of? Of course not, he is using the "disease" to avoid the ramifications and consequences of his actions!

I don't think people with Asps disease should go to jail nor do I see that in anyone's comments.... I do have this insane rationale that people who COMMIT CRIMES SHOULD GO TO JAIL, and Asps disease should not be an excuse to avoid punishment/accountability for that crime.

So Paul don't be ignorant and be an excuse monger... Aspergers did not cause him to commit the crime. Had he killed someone's loved one in a perfectly sane state and then said well I shouldn't be sent to jail because I can't handle it psychologically - should we just say OK, here's a lollipop, hope you don't commit any more crimes as we can't lock you up! 

Apparently he has a built in excuse to commit any crime that would result in incarceration - thank you Paul, can I have another?

Again, if he is arguing the merits of the case - I have no problem with that. If he is basically not contesting his guilt and saying he shouldn't be extradited because he can't handle the punishment... well then don't commit the crime in the first place! 

Don't worry though - the bleeding heart liberals will not let anything happen... It's not his fault.. it's the system's fault...the gov'ts fault.. the diet he was exposed to as a child... the violence on TV... no wait it was the little green men... anything of course but his own fault! It's not like a person should be held responsible for his own actions....

Now the crusaders will have a cause

With Gary shipped off to the U.S. for prosecution, his fanboys will have a cause for their crusade to spare Gary from personal accountability. If the Asswipe defense doesn't work, maybe they can claim that breaking and entering isn't really a crime? Let's see who they can convince of this fantasy.

Ignorant of Aspergers

Ugh, the comments people have been leaving because they simply do not understand a mental disorder.

Aspergers, is a mental disorder where their learning curve is not the same as regular people. They do have a curiosity to learn, but are unable to interact with people because of this disability.

Saying people with Aspergers should go to jail is akin to saying you should incarcerate your child at the age of 5.

Listen people, if you're going to make a quick decision about things, at least read up on the things you don't know. 
Don't be ignorant, or else you'll end up like Bush.

I completely agree as all evidence clearly points to massive corruption of the (not our) government here in America.

...and Obama is simply yet another part of their plan. If I had to guess the last two legit presidents I'd have to go with Kennedy and Carter as it's clear the forces that be wish to maintain their iron grip over us.

What is the saying? God save the queen! How about something a little more realistic: People save the people!

Would the British want us to extradite an American who hacked into their military? I bet they would, and I know we would comply.

I have no sympathy for this dumbass, i=he should got to jail, if for nothing else......just being so stupid!

Maybe he can get a reduced sentence if he agrees to help the pentagon secure their data! LOL

Unable to bear the pressures of incarceration?!?!

Wow... this may top the twinkie defense... I shouldn't be extradited and face possible prison because psychologically I may not be able to handle prison well?!?

It's one thing to argue the merits of the case... but come on! What if he had killed someone, or raped someone? In theory his "legal" argument should still hold, no? Wouldn't he still be psychologically unable to handle incarceration (regardless of the crime)?

At what point does someone say... well perhaps you shouldn't have committed the crime (allegedly?) in the first place. All we need now is for Obama's Hollywood buddies to get involved and start campaigning 'for the cause'.

It is not as if Gary uploaded pictures of naked ETs [aliens] working alongside winqy Yanks in the US military. You have done that yourself. If UFOs are nonsense why have they come down so hard on McKinnon? Joe American has never heard of Gary McKinnon, as news is spoon-fed, and often lacks a certain something worth its salt. There are space craft, or there have been craft, flying around that the public doesn't know about: how the US military has reverse engineered an anti-gravity propulsion system into an anti-anti-gravity pulse drive, and all from recovered alien space crafts, and that this propulsion system is being kept a top military secret, absent from airshow demos (which is unlawful, internationally), when they (USAF/USMC) should be righting a Net Bio (or it could be ghost written). In fact, Gary, may have been abducted by aliens, injected with alien DNA, and fear that US extradition will expose him to further probes. McKinnon worked at the investment banking arm of JPMorgan for a time (where “the guys on the trading floor treated [him] like the tea lady". What Gary really should have been in search of, was a cuppa. He should never have been phishing about with Joe, the MCE. Don't conker congers. That MS wizard's just a crazy old man. Help Gary McKinnon, Ob-1; you're his only hope. That's no moon; this aren't the druids you're looking for.

No Justice System in the EU?

It is simply sick that the EU (including the UK) cannot prosecute criminally this guy and then put an end to the whole affair. I do not want a European Union where a person gets extradited into a country which utilises torture and even murders people.
