A PARIS COURT has ordered Ebay to pay some 40 million euros (£31.7 million / $62 million) in damages to posh French bag and lipstick makers after "fake" copies of their stuff appeared for sale on the Interweb car boot sale site.
Bag firm Louis Vuitton Malletier and Christian Dior Couture said Ebay had been negligent in allowing the sale of couterfeit goods through its pages. Louis Vuitton's smelly water arm also got some of the action.
The decision follows the award of 20,000 euros (30,000 dollars) in damages earlier this month to French luxury group Hermes after one of its bags and a couple of bent copies were sold on the auction site.
Ebay reckons it can't be held responsible for the provenance the stuff flogged on its site, even though it makes money on every transaction. The French have other ideas.
The auctioneering outfit said it plans to appeal. µ
Having read this and many other articles on this topic, I'm just wondering if anyone could help me sue LVMH, as when I bought a bottle of their perfume (from a reputable store)I wasn't told or given any information prohibiting me from re-selling the item when I found I didn't like it,or found it to be unwanted.I have the reciept as proof it was legitimately purchased.The ruling the court gave may be well intentioned to stop easy fraud on ebay, but it has given large companies cart blanch to infringe my legal rights and ignore laws made to stop companies artifically forcing prices up and acting in a manopolistinc manner.
