Youtube wins sex on the beach case

Beach bonkers are fair game says Brazilian judge
Thursday, 28 June 2007, 16:07
IF YOU ARE semi-famous and have sex in public in Brazil then it is not Youtube's fault if someone sticks footage of you at it on its site, a Brazilian court has ruled.

Brazilian model Daniella Cicarelli and her bloke Tato Malzoni, sued Youtube after a fairly tame version of their sexcapades ended up on the site. They claimed the site violated their privacy.

According to Arse Technica, Youtube took the content down but that was not before another Brazilian judge ordered Youtube switched off for a while.

The case finally got to a full trial and Judge Gustavo Santini Teodoro ruled that the couple's privacy claims were unfounded. Basically if you are going to have sex in public, you really are not too concerned about privacy, he said.

Teodoro said that Cicarelli had a lack of "good faith" in pushing the privacy case. She was ordered to pay all court and lawyer costs and $5,000 to Youtube.

That should help shake the sand from her buttocks.
