Hacker McKinnon's mum squares up to US

THE US MILITARY believes it will soon get its hands on Gary McKinnon, the hapless British hacker who made a mockery of it while it was planning its invasion of Iraq in 2003. But it hadn't reckoned on Janis Sharp, Gary's mum.

Janis told the INQ she would chain herself and her son to a railing before she let anyone take him to stand trial in the US against hacking charges.

Listening to Janis on the INQ's podcast today, which records last Friday's protest at the UK's Home Office in support of Gary, it appears the US doesn't stand a chance in hell of getting McKinnon away from British soil involuntarily.

The US has effectively had permission to arrest Gary since last month, when the European Court of Human Rights threw out his appeal against his extradition order. But Gary's legal team may challenge the ECHR decision.

His team presented the court with evidence that he had Asperger's Syndrome, a form of autism that might have explained how his obsession with UFOs led him to hack into computers belonging to various arms of the US military. They presented their evidence of his condition the day before the court made its decision to refuse him a hearing. They believe it may not have been taken into consideration, even though European law insisted it should be.

The same evidence has led the Home Office to reconsider Gary's case. It is expected to announce the outcome any day, though Gary's Mum has also been advised that the Republicans wouldn't allow his extradition before the US presidential election because it would put the spotlight on their bungled security. Gary also has none other than Cambridge University's Simon Baron Cohen, world renowned autism expert, supporting his case.

Even so, Lucy Clarke, Gary's girlfriend, told the INQ that her letters to the Home Office had been "ignored". She had heard "not a dicky bird" in reply to a letter she sent Home Secretary Jacqui Smith in August.

No-one at the Home Office should have trouble recalling Gary's case after Friday, when his Mum led a rigorous round of slogan chanting outside the Home Office on London's Marsham Street. Janis continued her lung-straining chants relentlessly, from moments after her arrival until the time the police had allotted for the demonstration's end, an hour later. She sounded like she would shout slogans at the Home Office all day if the police would let her.

"Why aren't they representing us?" she asked the INQ. "Why are they selling UK citizens down the pan?"

Gary has been fighting his extradition for six years. A group of up to 30 supporters waved placards with such slogans as, "Honey pot or honey trap, or is your security really crap", "Stop the USA bully", "We are the only country in Europe to sign the 2003 extradition treaty", "British justice sold to America", "When America prey on the weak, we pray for them", "Disability is not a crime", and "Uncle Sam vs Asperger Man".

Members of the Autistic Rights Movement rubbed shoulders with supporters wearing Guantanamo-orange jump suits.

No-one from the Home Office came out to meet the demonstrators. The press office told the INQ on the scene merely that Gary's case was being considered and a report would be made "in due course". That shows considerable progress from July, when the House of Lords, the UK's highest court, refused McKinnon sanctuary from extradition and Gary's family were advised that he could be taken at any time.

So Mum's responsible?

In that case, Mum should spend the jail time for failing to take responsibility for her mentally-challenged spawn.

Since she is clearly the responsible party in the case of violation of an ally's security, they should allow here to remain free just long enough to see her defective child placed into a proper mental care facility equipped to handle his issues before packing up her kit for Fort Leavenworth.

breach of fundimental English Law

i think Gary could claim that his arrest and extradition is Blatently in breach of Magna Carter, as there was an excessively unreasonable amount of time taken to arrest or bring charges against him (more than long enough for america to introduce and change existing laws/international extradition agreements to include the crimes Gary is being charged under) .
Hopefully they can challenge his extradition with this.

Fear the Glory

Wow. A new defense at every failed one. Not a single good defense yet.

Too bad we slap serious and repeat computer crimes on the wrist here. Not to mention most defenders do end up profiting from being caught... so Gary, we are playing the worlds smallest violin for you. You'll probably end up getting out in 2-3 years in a low security prison resort and be a consultant here. 

If we actually made the punishment unprofitable then maybe we wouldn't have to worry about constant attack from foreign nations citizens. Maybe the amount of attacks would go down if the punishment were more severe or at least fitting the crime.

What is the crime for hacking into Parliament and military hosts over there?

Another self diagnosed "aspie" pretends they've got a mental problem to excuse their behaviour.

He knew what he was doing, he knew the penalty, he got caught, tough. Just because he doesn't like the consequences doesn't mean he gets to run away from his responsibilities. Was their security crap? Probably? Did he go through 7 proxies? Nope. Both sides are stupid and deserve what they got.

Extradite him already, we don't need more whinging stupid mummy's boys here.

Tell the US to stay away

Now the US wants nice Jewish boy from United Synagogue in London, Farshid Gillardian, on terrorism charges. Gillardian pointed out that he would hardly sell terrorism devices to Iran, as the US implies - and that the IT parts he did sell were sold openly and legally. Earlier this year they lost their case against Ian Norris. 
It it simply time we tell them to piss off - if we are really British that is, and not poodles.

Back off

I think its over due for the US to be told to get stuffed, they are the ones o should be on trial for not protecting its citizens !! Gary walked through an open door, hardly a mastermind hack. He should be trialed in Britain as the crime was commited on British soil. Illness or not, extradition and 60 years is way over the top, Back off US, Gary is one of ours, and we should be the ones setting the punishment.

Yet another

completely biased attitude from all the Daily Mirror readers out there. Aspergers syndrome can be extremely difficult to diagnose and if anyone who cares enough to give an opinion that makes some sense, then they should look into what they are talking about first. Gary did not need any spectacular skills to hack into the systems and as a personal computer user I am aware that if I don't put a password on something I want to protect then it's extremely vulnerable - the US Government presumabley thought they were different for some reason...

I suggest that anyone not up to date on this case should do some more research before ranting and raving any more...

Wake up and look at the case for yourself.

I see the level of ignorance that envelops your junk food ridden, television addled brains has no hope of declining. Clearly you see Gary Mckinnon being almost as dangerous as Osama Bin Laden. You see a computer and ufo geek who never laid a finger on anyone as lethal as a murderer or rapist. You believe proof to be completely immaterial. Yes that’s right. There is NO PROOF, or even requirement of proof of Gary's crimes of the destruction of data. Your lack of empathy for justice which fits the crime is sickening and the denial of due process is nauseating. The fascist ideals that have sprung from the self proclaimed freest nation of Earth while your constitution, bill of rights and way of life is its self hanging in the balance are incredible. While the economy crumbles and the dollar breathes its last breath, while struggling with the morality of an illegal and unjust war and the hundreds of thousands dead, while pardons are granted and the rich get richer, while your own nation in strangled and forced into the bondage of compliance with everything you are told. You still have a choice. You can be blind. Or you can see. But at this rate it will not be long before you no longer have that choice. If an unfortunate man like Gary can be so vilified by the vile repetition of un-investigated claims as to smear him to the level of being compared with a terrorist. Something is inexorably wrong.

The US need to leave Gary alone. Surely they have better, more important issues to deal with. Gary IS NOT A TERRORIST! We as a global community should not pander to the bully tactics used by the US. After all they do not rule the world.

There is no defense for stupidity or hacking

It's funny to read the fanboy attempts to defend Mckinnon's crimes. I guess because he is from the U.K. that makes his crimes resonable and acceptable to people who don't view hacking as a crime. 

Wait until your bank account gets hacked then you can Piss-off because hacking isn't a real crime, right?

Shameful

Gary's extradition to the U.S. doesn't require any prima facie evidence to be presented, and though we simply hand over our subjects, on U.S. demand, they do not have to reciprocate - because, apparently it would be against the U.S. constitution to hand over one of their citizens to a foreign power. Would that we had that privilege - we used to but it was signed away by a fool of a foreign secretary.

There's no evidence that Gary committed any crime he is accused of, but, to some people (judging by some of the posted comments), mere accusation is proof - typical of the warped mentality of these times of "guilty until proven innocent". You should all be ashamed of yourselves.
Gary should be put on trial in the U.K. - not packed off to a country that tortures. Certainly not since they have stated categorically that they intend to throw the book at him.

Get yourself educated and I don't mean Fox News...

Gauging from the level of ignorance from the responses to Gary’s plight by American Citizens it shows plainly that he will obviously not get a fair trail in the USA. This is not about a denial to what Gary has done. This is about a man who legally should stand trial in his own country. This is about an extradition treaty with the U.S that has been recently passed without a democratic vote in Britain and that no other country has accepted. This is about our civil liberties being slowly eroded under the guise of freedom. (Now there’s an irony). This is about the American government being highly embarrassed by their military’s incompetence. This is about high ranking egos being bruised.This is about a severity of punishment that far out weighs the crime. This is about America wanting to, and I quote, “Fry” a man with Asperger’s Syndrome. This is about a man who is by American admission NOT a terrorist and is of no danger to anyone yet they insist on treating him like one. All Gary wants is a fair UK trail because as you have proven it doesn’t look like he’ll get it over there. Try reading up about the facts before making your ignorant and ill informed political and social comments that are grossly insulting to people with disabilities. You should be ashamed of yourselves. Since when did Jesus preach such hatred? I thought we were allied to fight extremism not nurture it.

For a moment I thought you were talking about the current US president. :-)

We have the Computer misuse act in the UK to punish crackers, and Gary should be punished under UK law (he is after all, a citizen of the UK). Once again, the UK government has dropped it's pants and bent over at the beck and call of it's masters... There is allot of anger here in the UK about this case, mainly down to the sided nature of our relationship with the states. Lots of take, not much give!!

Free Gary McKinnon

U.S Government should be ashamed. They've been embarrassed by a man who they only knew about because he left warning messages notifying them that other hackers all over the world including China where in their systems, they should be thanking Mr McKinnon for pointing out their stupid mistakes in regards to leaving their computer systems unprotected with no passwords or firewalls and on an open net where any novice PC user could enter if they where to try.

It's absolutely ridiculous to think that Mr McKinnon is a terrorist the Real terrorists are currently adopting a War on Terror and are working toward a One Government One World Bank system... NWO where everyone is chipped and Big Brother will know your every movement of every day.

No proof?

So I hear there's no proof against GM. I know there's no proof against OBA. That's the u.s. for you. We don't need no stinking poofs... er proofs:) u.s. said you are guilty so it must be true.

Of course here in Canada we throw invite the cia to abduct our citizens and leave them to rot regardless of age. As long as they are the right skin colour they can stay in Guantanamo for as long as the u.s. is fighting a WOT. A WOT, you say? That's right, a WOT.

we need balance here

I find many of these comments quite distasteful. We are talking about the life of a human being who is suffering from Aspergers. 

What is there to gain from the US extraditing and persecuting this individual? 

It will cost the US taxpayer a considerable amount of cost and only highlight the inadequacies of the security in place. 

Will it deter people with Aspergers? No. Will it make the security any better ? No. Will it prevent it happening again? No. 

The best thing for the US to do is use Gary and people like him to audit the security the in place and highlight weaknesses. The punishment then would fit the crime (we would help the USA fix their security issues free of charge) which in itself would help improve the security and saftey of US citizens. 

So firstly I do not think we should be vindictive, nasty or sick in how we treat someone whatever country they come from and whatever they have allegedly done. It reflects very badly not on that person, but on the person who makes the comment.

Secondly there should be balance and thirdly perspective. 

However, right now, with the economic meltdown and massive deficits and unemployment about to mushroom, does anyone really want to spend taxpayer money prosecuting a disabled individual? 

I know where I would want my tax to go and it wouldn't be here!

US gov are losers

this is just the us government trying to save face because someone exposed their lax security. Get over it and be glad it wasn't someone more sinister. It's all right for them to snoop through our private stuff but they can't take it that someone cracked their security. They're only bothered because it is a sensitive time and they have so many dirty secrets they don't want getting out. Come on people, stand together on this and fight the arrogant pigheaded Bush 'regime'. It's out of your juristiction George, now run along.

You commit a crime you had better be prepared to pay for your crime. I don't care if Gary was looking for UFOs or Santa Claus, he knew hacking was a crime and now he's whinning because he has to pay for his crimes. 

The fact that he isn't even remorseful for his crimes is all the more reason to give him 20+ years in prison to ponder his worthless life. Supporting McKinnon is supporting crime. No matter how you spin it, he hacked military computers and he got caught. It's time to pay for his crimes.

I'm sure America is a beautiful country, shame it is inhabited by a nation of self diluded self indulgent idiots who don't give a crap about anyone except their own. One brit citizen is 100% worth more than a thousand US citizens. Have the US not got countries they want to bully, oil they want to steal. I pray the day the US is used for what it should be. Making T-shirts for well under a dollar instead of India. Or turned into a giant theme park entitled "IDIOTLAND". The Real Criminals

If someone had a boat full of holes and then launched that boat into the sea, they could hardly complain that water had come in without being laughed into ridicule.

Huge Joke or the Embarrassement of the century?

Prosecute the traitors responsible for the military's internet security, no passwords and no Firewalls before and after 9/11 is a real crime.

Even primary school children have passwords and firewalls. Grow up and get real and take the responsibility for having no security. 

If you're so keen on prosecuting criminals how about starting with the prosecution of the American War Criminals that invade countries and conduct illegal wars. 
How about extraditing the IRA criminals you protect, that bombed maimed and murdered U.K citizens including many children and blew the legs of British policemen and women and killed policedogs.

Definately a "Special Relationship" we could do without. 
The current U.S government are the real terrorists and the bullies of the world.
