RIAA slimes file sharing defendant

THE RIAA seems determined to drive away all of its customers, judging by what it said late yesterday, Wired reports.

Barely an hour after Jammie Thomas' attorney filed a petition in her continuing opposition to the RIAA's heavy handed tactics in Duluth, Minnesota, the RIAA issued a statement saying that she "continues to avoid responsibility for her actions."

They, and their lawyers, know that any court case isn't over until it's over, that is, until the last appeal is decided, but it seems to be trying to recover its public image by dumping further approbrium on the defendant.

Since they're obscenely rich and she's a lower middle class single mother of two kids, one must wonder where they left their brains and forgot to reclaim them.

It's a poor attempt to regain a little traction in the court of public opinion, but you can read the drivel here. ยต

if all fails

If all fails file sharers (aka pirates :D ) should help this woman and anyone in her position by chipping in. Maybe some specialised fund could be made by a pirate party in Sweden or other free country ( :P ). With this kind of fund we could fight RIAA or other like them properly. Ofcourse an antiabuse system could be established too so this fund would not become some commercial activity.

The bottom line

Yes, she is "a lower middle class single mother." Does that mean laws don't apply to her. Stealing is stealing. She decided to fight it in court, and she lost. She continues to deny that she did anything wrong. Sure sounds like not taking responsibility for ones actions to me.

She did the crime, now she should "do the time (pay up)."

No, you misunderstand her appeal

She has implicitly acknowledged that she perjured herself and was guilty of file sharing. That is NOT what her appeal is concerned with. They filed an appeal not about the jury instructions from the judge, but about the excessive fines they levied against her.

bottom line?

Interesting how badly all of this spirals out of control. Sadly, the world is not black and white. Two wrongs don't make a right, and if you have to break laws to prove someone is guilty, then it should be thrown out in court. Hopefully she can prove her point in the appeals process.

What about the origional judge?

The judge who prosecuted this case should have his ass in a sling. Why? he clearly ignored RIAA's Illegal tactics for gathering this information. I would say they should be disbarred. We do not need more unethical judges in office.

I hope this lady appeals and wins. And I am certain that 222,000$ is excessive. This is going to end badly for the RIAA.

How typical

I'm sry but this woman wasn't convicted of stealing, she was sued civilly (ironic, I know) for copyright infringement.

If this was a case of "theft", she would have faced criminal charges and the police would have investigated.

She also wasn't taking payment for the music so it wasn't piracy... = \

What's next, some spotty geek in high school is going to get sued for giving his new girlfriend a mix tape he recorded off the radio??

The RIAA could be using the power of viral advertisement (what file sharing without intent to make a profit amounts to) to get artists out there rather than using Nazi radio air time tactics. They should be chasing down large scale piracy networks that counterfeit their products with intent to sell them rather than putting nails through the palms of a single mother for such a minor infraction. 

Hell, give the women 20 hours public service cleaning the RIAA offices or something... = \

follow the blind

File sharing is not theft. It is preached as beeing theft. 
Sharing ideeas and "stealing" from others the ideeas was something that humans did from the second they ware borned as a species. 
It is what make us different from the animals, or you though it was the multitude of sexual techniques?
The people that buy this "IP rights" and "patents" krapolla are simply blind, blinded most of the time by their disgusting lust fo MORE.
Stick it in to your head: "Your ideeas belongs to "us"! Without 'us" you wouldn't have any ideeas, you will be just a vegetable."
