SCO loses crucial ruling

Its IBM claims are limited

ANTI LINUX bad boy SCO has lost a key battle in its patent battle against IBM.

SCO has sued IBM claiming Biggish Blue nicked some key parts of its Unix to make its version of Linux.

Now the judge over seeing the case has granted a motion by m'learned friends for IBM limiting SCOs claims considerably.

In fact according to Groklaw there is little left of SCO's case. What is left seems to be minor and very technical meaning that the while IBM case got a lot smaller. This rules out billions of dollars for SCO if it wins.

Judge Brooke Wells said that she was limiting SCOs case because it had failed to provide specificity on the numerous items. In other words SCO has not been able to meet the level of detail required by the Court.

As the Judge put it if an individual was stopped and accused of shoplifting after walking out of Neiman Marcus, they would expect to be eventually told what they allegedly stole. It would be absurd for an officer to tell the accused that "you know what you stole I'm not telling."

Or, to simply hand the accused individual a catalog of Neiman Marcus' entire inventory and say "it's in there somewhere, you figure it out." More here. ยต
