Intel email "trespass" appeal close

Hamidi's case goes to CA Supreme Court

KEN HAMIDI, for long a thorn in the side of the Intel Corporation, has submitted elements of his appeal to the California Supreme Court that emails he sent to the chip giant did not constitute trespass on Chipzilla's premises.

A lower court in California had ruled that mass emails Hamidi sent constituted trespass, and the ground breaking Internet lawsuit is being supported by a set of lawyers in a pro-bono case.

Dechert lawyers claim that saying emails constitute trespass is a dangerous move because if it is upheld, millions of people are guilty of trespass for sending emails every day.

Hamidi mass-emailed Intel employees on behalf of his organisation "Face Intel", which claims that the way it treats staff is not good.

His lawyers will argue that as Hamidi never set foot on Intel's premises after he left the company, an email cannot be construed as a trespass.
