Overloaded 3G network leads to lawsuit

A SAN DIEGO MAN has sued Apple and US wireless partner AT &T over their failure to deliver promised network performance for the Iphone 3G.

According to plaintiff William J Gillis Jr, the network has become overloaded due to the "high volume of 3G iPhones sold".

Gillis is seeking class-action, or group, status on behalf of other users. A 14-page complaint submitted on August 29 accused the two companies of misrepresenting the "speed, strength and performance of the 3G-bandwidth network ".

Apple originally claimed that the 3G was twice as fast as the 2007 Iphone. However, the company was recently forced to upgrade the network via a software patch after a number of users reported low sound quality and dropped calls.

It should be noted that Apple was also sued on August 19 over dropped calls and slow download speeds. The lawsuit alleged that the Iphone 3G connected to the network "less than 25 percent of the time”.
