Man puts Apple on spot, attempts to re-sell iTune ditty

Loony iTunes - does the right of first sale work?

ASKING whether the right of first sale exists with iTunes as it does with CDs, a person is attempting to resell a tune he bought from Apple on Ebay.

He says in a post on a web site: "I only spent $0.99 on [the song], but I bought the song just as legally as I would a CD, so I should be able to sell it used just as legally, right?"

He said that he was contemplating a couple of ways that the transfer of ownership might take place. One could be to call up Apple and ask it to do it for him.

The other would be to place it on Ebay, which is exactly what he's done. You can find his original filing here, while the Ebay song - Double Dutch Bus by Devin Vasquez, can be found for sale here.

This could be an interesting one to watch. µ
