IBM doesn't make hard drives any more. It sold its hard drive unit to Hitachi.

Although IBM has agreed to the proposed settlement, it still denies any liability for problems with Deskstar 75GXP hard drives, which had been on the market since March 2000.
The class action proposed settlement applies to "all persons and entities" in the USA who bought for their own use a qualifying 75GXP HDD from IBM or from its authorised channel, or who bought a PC which contained a qualifying unit.
IBM employees need not apply, nor people who have released Big Blue from liability. The Deskstar 75GXP models are the DTLA 307-015, the 020, the 030, the 045, the 060, or the 075.
And because it's a USA based class action, there's no clear method for people outside that country to recover money from IBM.
Claimants need to apply on or before the 29th of August 2005. The claim form is here. A separate claim form is needed for each qualifying Deskstar.
