SOCIAL NETWORKING outfit MySpace has sued a Colorado man claiming he used the service to send out spam to its members.

Scott Richter and his various companies, including OptInRealBig.com and Mediabreakway.com was once named as one of the top three spammers from the US.

Associated Press reports that MySpace is miffed that he sent millions of junk messages to members using technology that made the messages appear to come from individual members' accounts. It claims he nicked punters' passwords to gain access to email accounts.

The lawsuit requests damages, an injunction preventing Richter and his companies from accessing MySpace, and repayment of all profits gained as a result of the activity.

The "spam" included adverts for free ringtones, Lacoste polo shirts or other items, the lawsuit alleges. In 2005, Richter paid $7 million in a settlement with Microsoft over spam messages. He also settled a similar lawsuit with then-New York state.
