Microsoft sued over Xbox 360

A FLORIDA man is suing Vole over the fact its Xbox 360 scratches game disks. Jorge Brouwerhas claims the consoles are "negligently designed and manufactured" and that Vole has received thousands of complaints but has not replaced all scratched disks. As you might expect he is is seeking class-action status.

Brouwer said his Xbox 360 scratched his "Gears of War" which sounds a bit painful and his "Madden NFL 07." Vole offered to replace them for $20 in used greenbacks.

According to Associated Press, his case has nothing to do with Microsoft's recent acknowledgment that some of its Xbox360s could come down with a strange complaint called "general hardware failure" or overheat and self destruct as it is known in the rest of the world.

Brouwer's lawsuit is using it as evidence Microsoft "is well aware that the Xbox 360 console has been defective since its introduction to the marketplace".

The lawsuit also mentions investigations of similar consumer complaints conducted by a Dutch television program, which found that one of nine consoles tested scratched a disc after five hours of play.
