WHILE A FRENCH court decided Ebay was at fault for allowing the sale of fake "luxury" goods made by French outfits through its pages, a US court has gone down a different path.
According to a US federal judge, trinket maker Tiffany & Co failed to prove that It was Ebay's fault that fake Tiffany clobber appeared for sale on the auction site's pages.
The wigless wonder suggested that Tiffany migt have been better off going after the individaul sellers rather than attempting to shoot the messenger.
"Given Tiffany's choice to sue Ebay, rather than individual sellers, and this Court's conclusion that Ebay does not continue to supply its services to those whom it knows or has reason to know are infringing Tiffany's trademarks, Tiffany's claims against Ebay must fail," the judgement released today read.
Tiffany brought case back in 2004, alleging the online auctioneer was negligently allowing the sale of fake stuff. The court evidently disagreed.
Last month, Ebay was ordered to pay some 40 million euros (£31.7 million / $62 million) in damages to posh French bag and lipstick makers Louis Vuitton Malletier and Christian Dior Couture after "fake" copies of their stuff appeared for sale on the auction site. �µ

If an offline auctioneer allows fake stuff to be sold through it's catalogue without taking steps to establish its authenticity, they are guilty of flogging fake goods.

If Ebay is prepared to take a slice of the cash from a sale, then it should also be prepared to take the same sort of steps real auctioneers do to prevent dodgy goods being sold.

"Alexander Witt, a spokesman for eBay in Germany, said the ban was in response to protests from animal rights groups that believe clothing and other goods claiming to contain rabbit or mink fur are actually made illegally from cats and dogs.

"We want to forbid these dealers from our marketplace," he said, adding that the ban would encompass eBay's sites in Austria, Germany and Switzerland.

Witt said the ban would be extended to France, Italy and Spain, with more European countries to follow. A previous ban is already in place in the United Kingdom, Witt said."
