MP cries mercy for McKinnon
THE MEMBER of Parliament for Gary McKinnon's home town has appealed for him to serve time in a British jail if he is convicted of hacking charges in a US court.
David Burrowes, Conservative MP for Enfield and Southgate, where Gary lives, made the appeal in a Parliamentary petition today. It called on the government to have sympathy for him as a sufferer of Asperger's Syndrome.
The petition, or Early Day Motion, urged Jacqui Smith, UK Home Secretary, to stay Gary's extradition, "until such time as she receives express assurances from the US Government that in the event of his being found guilty and sentenced to a term of imprisonment they agree to the immediate repatriation of Mr McKinnon post trial to serve any such sentence in the United Kingdom.”
It noted that Israel and the Netherlands routinely sought such assurances from the US government before they agreed to the extradition of anyone "suffering from medical or mental health disabilities".
Burrowes filed the petition after a personal appeal he made to the Home Secretary was ignored. He wrote to Jacqui Smith two week's ago, appealing for Gary to serve time in a UK jail if he were convicted. He asked whether Smith had fully considered Gary's medical condition.
The Home Secretary had delayed Gary's extradition in the summer while she considered whether his Asperger's made any difference to his case. She said it didn't and even expressed scepticism about his diagnosis being made at the nth hour before his extradition.
Admiral The Lord West of Spithead, the UK Security Minister, replied to Burrowes letter on Monday. Gary has had every opportunity to seek protection from the courts, he said. The courts denied him, so the government has a serious obligation, duty even, to honour its extradition treaty with the US.
But Admiral The Lord West of Spithead did not satisfy Burrowes, who wanted the government to secure a guarantee that, should Gary be extradited and convicted in a US court, the US would repatriate Gary to serve out his sentence in the UK.
Burrowes has put the question to Admiral The Lord West of Spithead again, in another letter. His parliamentary petition will be published tomorrow.
Asperger's Revelation
Admiral The Lord West of Spithead did make a vague reference to the matter of
Gary's repatriation, but in a way that raised more questions than answers.
McKinnon's supporters have asked the UK to follow the example of Israel and the
Netherlands, which don't allow people suffering "medical or mental health
disabilities" to be extradited to the US until it can be guaranteed that, on
conviction, they will be repatriated to serve their sentence at home.
McKinnon's lawyers asked the Home Secretary to consider this when she reviewed his extradition on the grounds of his recently diagnosed Asperger's Syndrome.
The Home Secretary's subsequent refusal to allow Gary's condition to effect his extradition contained no reference to the request for compassionate repatriation. So this request formed part of the basis of Gary's appeal to the High Court for a judicial review last week raised the matter of Gary's compassionate repatriation again.
The Home Secretary should at least ask the US to send Gary to a British jail if he is convicted, it said. However, Admiral The Lord West of Spithead's letter to Burrowes implied that the Home Secretary had indeed considered the issue of compassionate repatriation, even though her deliberations had not presented in her rejection of Gary's Asperger's plea.
"Mr McKinnon's solicitors submitted further representations to us on 29 August and on 9 September which, amongst other matters, raised the issues of Asperger's Syndrome; and the procedure which Israel and Holland follow when extraditing their own nationals," said Admiral The Lord West of Spithead's letter.
"We reconsidered the case but found no grounds for overturning the order for surrender as made in July 2006," it said.
Perhaps Admiral The Lord West of Spithead can tell the High Court why this question was ignored, since the Home Secretary neglected to tell Gary.

Admiral The Lord West of Spithead, the UK Security Minister, and Jacqui Smith, the Home Secretary, are not qualified to make a judgement in such CyberSpace affairs. Their Knowledge/Intellectual Property in the Field is Deficit and any presumption on their part that it is anything otherwise is a gross arrogance compounding an obvious ignorance.

And the fact that the UK does not have* a dedicated ...and obviously a brand spanking new ..... CyberIntelAIgent Directorate, to illuminate on such Virtual Matters as are now wresting Controls from Failed Establishment/Corrupted Orders, is tantamount to being a treasonable abdication, rendering UK Interests vulnerable to foreign abuse and Third Party Control.

J'accuse the UK of, at best, Ignorant Negligence in such Matters and, at worst, ........ well, in the light of the above, they may wish to Allocate some of the recent Darling Pixie Dust/Magically Invented Liquidity Funds to a Principled Principal Lead Driver Creating CyberIntelAIgent Feeds which Beta Manage Human Perception on a Universal Scale with a Globally Accessible Tale. In that Simple Way, will the Government machine have a Viable Input Control to Virtual Output 42 Power CyberSpace Governance Systems.

Get a back bone!
The US don't even have an extradition agreement for US citizens to be sent to the UK for trial, so how about actually protecting one of our citizens from the US scapegoat and knee jerk justice system.
You never know, he might even vote for you next time if he's able, and God knows you're gonna need every one you can get!
The pandering by politicians is so synthetic. You'd think anyone with a clue would know this fool has no influence on the outcome of Gary the-hacker-McKinnon's fate. Gary decided his own fate when he believed he was above the law and went looking for: either UFO's or the holy grail - you decide.

Whatever the case, Gary deserves 20 years in prison and hopefully he will get it in the U.S. If he actually has a mentally illness that magically developed after he was caught hacking and stalled extradition, then the U.S. will be glad to help Gary with his illness. I expect a 50 KV electrical shock therapy would be a good starting point to a cure.
