AMD says antitrust documents won't be sealed

But that remains to be seen

A REP from AMD claimed that documents filed in its antitrust case against Intel won't be sealed.

But an Intel rep replied that while "technically" AMD is correct, it still remains to be seen how many of the "millions of documents" collected during the discovery period will be kept from the public.

AMD said: "There has been no discussion among the parties regarding the sealing of documents. To the contrary, we're working on a mutually agreeable protective order. We expect that the final protection order will serve the public's significant interest in this case."

In contradistinction, an Intel rep said: "The discussions on the protective order will deal with how the documents are treated before the eventual trial. When we go to trial the judge will determine which documents remain under seal. The underlying concern deals with how to best protect the confidential information, trade secrets etc. during the early stages of the case such as discovery. As you saw from the agenda on file with the court the details on that protective order still need to be worked out."

So it will be a little while before we know what's going to be public and what's not.

And in the meantime all of you should have your eyes tested because even if a chunk of the stuff is sealed, there are still going to be millions of documents to wade through.
