Spammer can't take Spamhaus IP address

AN OUTFIT identified as a spammer cannot take the anti-Spam organisation Spamhaus's IP address, the body in charge of the Internet has ruled.

E360, which sued the British outfit Spamhaus in a US court, had attempted to shut the operation down by asking a court to taking its IP address.

However ICANN said that so far the court has not made a ruling demanding that ICANN hand over the IP address. But if the court does this, ICANN will have to tell it to go forth and multiply.

In an official statement, ICANN said that it cannot comply with any order requiring it to suspend Spamhaus.org or any specific domain name because ICANN does not have either the ability or the authority to do so.

The statement said that ICANN has no direct knowledge as to the merits of the claim by e360 against Spamhaus, the reasons why Spamhaus withdrew its answer, or why Spamhaus took no further action to defend the matter.

But it warns that if ICANN were properly brought before the court in this matter, ICANN cannot comply with any order. ICANN said that only the Internet registrar with whom the registrant has a contractual relationship, and in certain instances the Internet registry, can suspend an individual domain name.
