Community punishment?

I see that the community is to be punished by the release, without punishment, of a criminal.

Surely evidence is evidence however obtained. If a crime is commiteed in obtaining the evidence those committing the crime should be punished.

I THOUGHT community punishment was against the Geneva Convention.
