Bush, like most Governments, supports the rich people. Thats hardly surprising - they are the ones that fund his election campaigns and invite him round to their mansions for the odd lobster lunch. Whats harder to understand is why millions of poor dupes still vote for him. And thats repeated all around the world in the other wealthy (relatively) capitalist nations. Maybe the poor have been ripped off for so long now they have gotten to like it.

Just wait till their kids and family wind up in court for copying a movie...

McCain Campaign Feels DMCA Sting
Yesterday, the McCain-Palin campaign sent a letter to YouTube describing the troubles it has been having with bogus DMCA takedowns targeting its videos:

[O]verreaching copyright claims have resulted in the removal of non-infringing campaign videos from YouTube, thus silencing political speech. Numerous times during the course of the campaign, our advertisements or web videos have been the subject of DMCA takedown notices regarding uses that are clearly privileged under the fair use doctrine. The uses at issue have been the inclusion of fewer than ten seconds of footage from news broadcasts in campaign ads or videos, as a basis for commentary on the issues presented in the news reports, or on the reports themselves. These are paradigmatic examples of fair use...

It's heartening to see a presidential campaign recognize the importance of fair use and "remix culture" (the Obama-Biden campaign has also been the victim of frivolous takedowns from big media companies, so this is a bipartisan problem). EFF, the ACLU, Harvard's Citizen's Media Law Project, and Stanford's Fair Use Project have been making the same point for several years now. EFF has also been providing direct legal assistance to victims of DMCA abuse.

Unfortunately, the solution proposed by the McCain campaign addresses only the tip of the iceberg:

[W]e believe that it would consume few resources--and provide enormous benefit--for YouTube to commit to a full legal review of all takedown notices on videos posted from accounts controlled by (at least) political candidates and campaigns.

The obvious problem with this solution? It assumes that YouTube should prioritize the campaigns' fair use rights, rather than those of the rest of us. That seems precisely backwards, since the most exciting new possibilities on YouTube are for amateur political expression by the voters themselves. After all, the campaigns have no trouble getting the same ads out on television and radio, options not available to most YouTubers.

Let's start by identifying the real villains here: the major news media outlets. They are the ones censoring these political ads, based on the use of a few seconds of their footage. The networks need to back off and give fair use a wide berth. So let's start by shaming the bad guys here. In addition, lawsuits might help. Under the DMCA, both the campaigns themselves and YouTube have standing to sue those who send clearly bogus takedown notices. (EFF has represented video creators in a number of these cases, including against Viacom.)

There are other possible solutions, as well. Stay tuned for our specific ideas on what YouTube can do to protect fair use while staying within the bounds of its DMCA safe harbor protection (hint: as the McCain-Palin letter points out, you don't need a safe harbor if the video isn't infringing, something that human review by YouTube should be able to determine).

UPDATE: The McCain-Palin campaign has identified the news outlets behind the YouTube removals: CBS, Fox News, and the Christian Broadcasting Network. We noted above that NBC has targeted an Obama-Biden video for removal. That's four news entities that should know better.

Schools could do the same right? Get students to pay five cents each on a choice video and they get their turn to bring it home while the teacher holds the property contract signed by the students approved by the parents first right?

piracy is a direct result of abusive over charging, as if anyone can say paying 10 $ for an album in which the artist makes maybe a dime is fair to them and to us as consumers. The lions share goes to these bl**dy parasite middlemen, not the people who created these works.

And never mind the fact the formats change every few years so you have to rebuy what you already own!!

Charge what the products are really worth and get rid of these middlemen lining their pockets with other peoples hard work and piracy will die out on its own, 
who would pirate a song if it was 10 cents? 
who would pirate a movie if it was 25 cents?

We are systematically overcharged and these laws are created to force these higher prices on us, a true free market would adapt to piracy by making their prices fair enough that people wouldn't bother.

At its foundation piracy is pure protest against abuse.

the problem facing economy isn't capitalism, its these parasitic middlemen, who make 1000x what their services are worth. Not just on this subject but right across the board, look at any market niche that's overpriced and you will find a greedy middleman sitting right in the middle of it.

Then it is time to bring ACTA to a conclusion, isn't it?

This is not just a law to support the MAFIAA. The MAFIAA is just the first organization to terrorize the whole world. Chasing "pirates" makes great headlines. Headlines are good propaganda tools to justify the law. And who is better suited to produce the headlines than the entertainment industry, which happens to own the "news" networks? And which politician would not want the money and headlines from this industry?

But to find the truth in the news, you need to look at the missing parts. The missing parts are the intellectual property rights beyond entertainment and the patent system. Those are the US interests which need to be enforced world-wide.

Take malaria and AIDS as examples. The pharmaceutical industry in the US will have an even tighter grip on other countries once the Intellectual Property Czar sends out his hangman's assistants into every country. It is actually good for business that malaria kills one child every 40 seconds, in countries which cannot afford to pay for the patents.

Genetically modified food is another example. It is a trap.

This gamble may fail, if enough countries in Africa, Asia and Latin America reject it. Far too many jobs have been exported from the US to other countries. Countries like Brazil, China and India develop far beyond the role of the traditional colony as source of cheap labor. The EU has an interest in those countries as well. Not too long ago, Africa sent an EU delegation home to rethink the terms of a future treaty. I bet they will.

What happens if we see a collapse of the US intellectual property scheme, now after the downfall of the US banking system? BTW, how many children were killed by malaria while you read this comment?
