I think Apple can argue that if user knew that his/her device will be modified by going to a certain web page user has decided to break the rules of warranty.
It's clever because since the user only visited a site apple cannot claim he/she 'modified his phone and because of that warranty doesn't apply anymore'.

Now, if anyone would like to visit my website, I'm offering to exploit clients that do so. It will patch your computer up all nice and good, I promise.

Only unpatched systems need apply of course.
