Hackintosh clone baits Apple lawyers

Site vanishes in hail of pastel-hued lawsuits

FLORIDA-BASED Tech company Psystar is advertising OpenMac, a non-Apple system capable of running unmodified OSX Leopard.

With prices starting at £399 the new machines could represent great value for money, but exactly how long the company will last once Mr Jobs releases the Dogs of Law remains to be seen.

As far as we can tell, installing OSX on anything other than an Apple badged box contravenes the software's end user licence and, as Psystar is offering to sell you an OpenMac with the system pre-installed, we reckon it's just asking for a kicking from Steve's men in grey suits.

With a whole raft of build-to-order options available, Psystar maintains it can match Mac Pro performance at Mac Mini prices.

But if you want Apple design and lickability, you'll still have to stump up arm+leg for the real thing. µ

WTH!?

So in other words....If I buy MAC OS X 10.5 at the store and proceed to INSTALL IT on my own Hardware, which is the same as APPLE HARDWARE..(Intel processors, samsung memory, AMD or Nvidia video cards, Seagate HDDs)..

...Because my hardware doesn't have a MAC SEAL OF APPROVAL since I didn't pay 2000 - 3000 for the same thing I bought at less than half price...I have absolutely no warranty and it voids any warranty I purchase covering the software!?

apple-labeled hardware

I believe the actual verbiage in the OS X Leopard license restricts your installing of it to 'Apple-labeled hardware'.

Conveniently, the Leopard install kit comes with several Apple labels.

Presumably, one could apply an Apple label from a legally-acquired kit to the hardware first, and then install the OS legally.

i no different to buying a server os and not being able to use it at home and buy a home based antivirus to run on it most will come up sayign you is running a server os me no likes but just removing the os dependanct from the msi and it works fine

its all the same old con at the end of the day trying to get more money out of you when its all the same at the end of the day

Apple Labeled

People get miffed by these arbitrarily restrictive contract terms, and it is SO hard to resist the temptation to just forget about them when there is absolutely nothing (physically) stopping you.
I put OSX on my windows machine mistakenly because I didn't read all the terms & conditions that say you're not allowed to. But you know what? In the last 12 months, I absolutely never use OSX! I'd uninstall it now that I know the rules, but I just never get around to booting it up.
I swear, if Ubuntu ran on my computer I'd use that instead (maybe it does, I haven't checked in about 12 months). Oh well with SP1 Vista isn't so bad any more, maybe I'll just forget about it -- too much inertia to change.

But what defines an Apple label? Is it the case? The motherboard? If I take a Mac Pro, gut it down to the motherboard which I transfer to a new case and build up a new system, is that still a mac by definition of the EULA?

They might be on to something here. Take a computer and put in something that originally came with a mac in it, in which case it should satisfy the apple logo detail.

Oh how the mighty have fallen

Jobs has let his ego grow to large because no one will pay 6 grand for a mac when the same hardware can be found on a windows system for 2 grand. Albiet PC's dont have as fancy packaging, but hey how long is it going be till that system is setup on your desk anyways.

I'd have to say that apple's still for people who think they're better than everyone else. I hate it when apple fanbois spout off about windows, because they're exactly the same. They know to little to have a clear concise picture of OS's today or, They're on their knee's asking Jobs. "Where the FCK is it"

Unix is what I use at work and Linux at home. Yes OSX has bit's and peices of a unix kernel, but when you're at the john and slice a loaf to put in your OS, to complement something which works for a living, It's gonna blow no matter what.

It's about time that a real exploit for Mac's are used to set people who are spoon-fed straight because everyone is tired of apple heads boasting about your problems when they have the same condition as well. Hypercrites or moma's boy's needing a beat down. Either way the eagles load for whoever try's to bounce.

match mac pro performance?

how can they claim to match mac pro performance with a core 2 duo? a new mac pro has dual-quad (thats 8. 4x as many) cores. there is no comparison. and, it is not even cheaper than a mac mini. mac mini is $599, once you've added firewire and leopard (both included with mac mini) to the open mac, its $604.99. and you don't get the remote for front row. it does have more ram/hd/cpu, but with this kind of entry-level computer, does it matter?
they are trying to cash in on apple's success by flogging cheap and nasty computers, i hope they do get shut down!

Site is up but slow

They are using an EFI emulator to get around OS X interrogating the hardware. Pretty creative.

...which means it will be crushed under the heel of the Apple attorneys.

Whats the big deal ?

I doent know what the big deal is, I installed OSX 10.5 ( Leopard) months ago. I DUEL boot XP/OSX 10.5. (Leopard) with np at all. Mac OS X v10.5 Leopard is also alot cheaper then Windows only cost me $129 CAD.

Apple monopoly

Psystar is probably hoping apple will sue.

Monopoly def:

In Economics, monopoly (also "Pure monopoly") exists when a specific individual or enterprise has sufficient control over a particular product or service to determine significantly the terms on which other individuals shall have access to it. [1] Monopolies are thus characterized by a lack of economic competition for the good or service that they provide and a lack of viable substitute goods.

Under this definition apple is liable for creating a monopoly.... Their eula voids any form of economic competition. Dont forget you can write up any garbage you want in a eula, but its still limited by pre-existing laws and regulations.

Its time Apple got slapped for its monopoly business model.

Any bottom feeding lawyers reading this? Run to your partners and sue apple!! Do some good for a change you greedy bastards!!

Apple Hardware...

So I could theoreticaly go and purchase my self osx leapord and install it onto a partition on my iPod? that's apple hardware... so this would not be in breach of the eula?

Sounds like a plan, but I don't use Intel processors so that might be a problem.. Also using apple would mean I'm stuck with a long list of software I can't use. As much as I hate MS there's no real alternative (I tired linux and I'm too lazy to make it work).

Apple need to drop their prices and encourage developers to write software for them! Then they'd compete with microsoft across a wider range of markets and we might get some good products with this new competition between the companies.

By your definition any company could copy any other company's products or services, and there would be no repercussions, let alone any copyrights. Apple does not own the personal computing space, they own their own verison of it, which they may define in any way they please. You can go elsewhere to get a computer. Let's not let presumed personal prejudice color rational thought. By the way, a monopoly is not illegal, abuse of a monopoly is.

yes they can claim to match the performance. The base configuration of a Mac pro is 1 quad core cpu and the open pro comes with a faster hd. Once you upgrade the graphics card on both to a geforce 8800GT keeping the ram at 2gig on both the openpro will cost you $1704.99 while the base macpro will cost $2449.00.

Similar config, similar performance and over $700.00 in savings... check your details before making claims.
